HomeMy WebLinkAbout09-008 1 RESOLUTION NO. 09-008 2 File Number: PNRD 06-008 3 4 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ST. 5 LUCIE COUNTY GRANTING APPROVAL FORA PRELIMINARY AND 6 FINAL PNRD (PLANNED NON-RESIDENTIAL DEVELOPMENT) SITE 7 PLAN FOR THE PROJECT KNOWN AS ST. LUCIE BUSINESS PARK 8 STORAGE PLANNED NON-RESIDENTIAL DEVELOPMENT LOCATED IN 9 THE PNRD (PLANNED NON- RESIDENTIAL DEVELOPMENT) ZONING l0 DISTRICT FOR CERTAIN PROPERTY IN ST. LUCIE COUNTY, FLORIDA. 11 12 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the 13 testimony and evidence, including but not limited to the staff report, has made the following 14 determinations: 15 16 1. St. Lucie Self Storage, LLC, presented a petition fora Preliminary/Final PNRD 17 (Planned Non-Residential Development) Site Plan approval for the project to be known 18 as St. Lucie Business Park Storage Planned Non-Residential Development for 19 property located on Lot #1, St. Lucie Business Park on Business Park Drive, 610 20 feet west of the intersection of US Highway #1 and Business Park Drive in the PNRD 21 (Planned Non-Residential Development) Zoning District consisting of: 22 23 o a four-story, 88,270 square-foot, self-storage building on a footprint of 22,670 24 square feet ; 25 0 12,184 square feet of paved area for 14 parking spaces and loading area; 26 0 2,780 square feet of existing paved driveway; 27 0 37,634 square feet is the total impervious area of the project; and 28 0 24,215 square feet of open space and landscaping. 29 30 2. On April 7, 2009, this Board held a public hearing on the petition of St. Lucie Self 31 Storage, LLC, for aPreliminary/Final PNRD (Planned Non-Residential Development) 32 Site Plan approval for the project to be known as St. Lucie Business Park Storage 33 Planned Non-Residential Development, after publishing a notice of such hearing in the 34 St. Lucie News Tribune and notifying by mail all property owners within 500 feet of the 35 subject property. This Board remanded the petition to the Development Review 36 Committee (DRC) with the direction to reduce the height, size and mass of the 37 building. 38 39 3. The Development Review Committee has reviewed the revised site plan for the 40 proposed project and found it to meet all technical requirements and to be consistent 41 with the general purpose, goals, objectives and future land use maps of the St. Lucie 42 County Comprehensive Plan and the Code of Ordinances of St. Lucie County. 43 44 4. On January 15, 2009, the St. Lucie County Planning and Zoning Commission held a 45 public hearing on the petition of St. Lucie Self Storage, LLC, for aPreliminary/Final 46 PNRD (Planned Non-Residential Development) Site Plan approval for the project to be 47 known as St. Lucie Business Park Storage Planned Non-Residential Development, JOSEPH E. SMITH, CLERK OF THE CIRCUIT COURT Pa e 1 SAINT LUCIE COUNTY 9 FILE # 33951 D4 09128/2009 at 09:14 AM Resolution No. 09-008 September 15, 2009 OR BOOK 3131 PAGE 2459 - 2466 Doc Type: RESO File No. PNRD 06-008 RECORDING: $69.50 1 after publishing a notice of such hearing in the St. Lucie News Tribune and notifying by 2 mail all property owners within 500 feet of the property boundaries at least 10 days 3 prior to the hearing, and recommended the Board of County Commissioners approve 4 the subject petition, for the property depicted on the attached map as Exhibit "A" and 5 described in Part "B" below. 6 7 5. The proposed project is consistent with the standards of the St. Lucie County Land 8 Development Code for Planned Non-Residential Development Preliminary and Final 9 Site Plan. 10 11 6. The proposed project will not have an undue adverse effect on adjacent property, the 12 character of the neighborhood, traffic conditions, parking, utility facilities or other 13 matters affecting the public health, safety and general welfare. 14 15 7. All reasonable steps have been taken to minimize any adverse effect of the proposed 16 project on the immediate vicinity through building design, site design, landscaping and 17 screening. 18 19 8. The proposed project will be constructed, arranged and operated so as not to interfere 20 with the development and use of neighboring property, in accordance with applicable 21 district regulations. 22 23 9. The proposed project will have water and sanitary sewer service provided by Port St. 24 Lucie Utility Systems Department. 25 26 10. The applicant has applied for and received a certificate of capacity, a copy of which is 27 attached to this order as Exhibit A, as required under Chapter V, St. Lucie County 28 Land Development Code. 29 30 31 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie 32 County, Florida: 33 34 A. Pursuant to Section 11.02.05 of the St. Lucie County Land Development Code, the 35 Preliminary/Final PNRD (Planned Non-Residential Development) Site Plan to be 36 known as St. Lucie Business Park Storage Preliminary and Final Planned Non- 37 Residential Development, is hereby, approved as shown on the site plan drawings 38 for the project prepared by Friscia Engineering on September 21, 2005, last revised on 39 August 6, 2009 and date stamped received by the St. Lucie County Growth 40 Management Department on August 26, 2009, subject to the following conditions: 41 42 1. No development permits shall be issued until complete sets of sealed constructible final 43 engineering plans, supporting calculations and survey data for the site work and offsite 44 improvements are approved by the Office of the County Engineer, Public Works 45 Department, Utilities Department, Environmental Resources Department, Growth 46 Management Department, Fire Department, and any other agency that may be 47 determined by the Director of Growth Management to be necessarily involved in the 48 review and approval of the constructible final engineering plans for the site work and 49 offsite improvements. The. determination of whether or not plans submitted by the 50 applicant constitute a complete set of constructible plans shall be made by the Page 2 Resolution No. 09-008 September 15, 2009 File No. PNRD 06-008 1 departments involved in the plan review within five business days of the date the plans 2 are received in the Department of Growth Management. 3 4 2. Prior to the issuance of a Certificate of Occupancy, the developers, their successors or 5 assigns, shall either construct a 5-foot wide sidewalk along the development frontage on 6 Business Park Drive in accordance with Section 7.05.04, or execute an agreement to pay 7 a fee-in-lieu of construction .for sidewalks or multi-purpose paths and remit to the 8 County the required funds within 60 days after receiving final site plan approval. The 9 acceptable method of payment shall be a certified check payable to St. Lucie 10 County. A copy of the standard "Agreement" can be obtained by visiting the 11 St. Lucie County Public Works Department website at: 12 http://www.stlucieco.gov/public works/index.htm. 13 14 3. The developers, their successors or assigns, shall be required to have a traffic signal 15 warrant study conducted at the intersection of Business Park Drive and South US-1 16 between 180 days and 240 days after the issuance of a certificate of occupancy. If a 17 signal is warranted by that study, the developers, their successors or assigns, shall 18 design and install the traffic signal in coordination with FDOT. 19 20 4. Hours of operation shall be limited to between 6:00 a.m. and 10:00 p.m., seven days per 21 week. 22 23 5. Prior to issuance of a Vegetation Removal Permit or Exemption, the applicant shall 24 finalize an improvement agreement acceptable to Environmental Resources Department 25 covering the cost of all required landscaping, irrigation, tree mitigation, tree relocation, 26 and related improvements shown in the site plan. A copy of this agreement can be 27 obtained by visiting the SLC Environmental Resources Department website at: 28 http://www.stlucieco.org/Environmental Resources Department/index.htm. 29 30 6. The applicant will comply with any state and federal agency regulations and 31 requirements. Prior to issuance of a Vegetation Removal Permit or Exemption, the 32 applicant shall have obtained and provided Environmental Resources Department with 33 copies of any required federal and state permits. If federal or state agency compliance 34 requires modification to the development plans, the applicant will promptly modify the 35 plans and submit to SLC for review and approval as required by the LDC. The applicant 36 will not use the County's development approval to prevent compliance with any federal 37 or state agency requirements. 38 39 B. The property on which this PNRD Preliminary/Final Site Plan approval is being 40 granted is described as follows: 41 42 LOT 1, ST. LUCIE BUSINESS PARK, LESS THE SOUTH 19 FEET, ACCORDING TO THE 43 PLAT THEREOF, AS RECORDED IN PLAT BOOK 28, PAGES 9 AND 9A, PUBLIC RECORDS 44 OF ST. LUCIE COUNTY. 45 46 SECTION 26, TOWNSHIP 36 SOUTH, RANGE 40 EAST, 47 48 PARCEL CONTROL NUMBER: 3426-702-0002-000/6 49 50 CONTAINING 1.42 ACRES 51 52 LOCATION: The west side of Business Park Drive, 610 feet west of the intersection 53 of US Highway #1 and Business Park Drive 54 Page 3 Resolution No. 09-008 September 15, 2009 File No. PNRD 06-008 1 C. The approvals and authorizations granted by this Resolution for the purpose of 2 obtaining building permits on this property, shall expire on September 15, 2011, unless 3 the developer has obtained building permits for the site plan described in Part A or an 4 extension has been granted in accordance with Section 11.02.06, St. Lucie County 5 Land Development Code. 6 7 D. Preliminary/Final PNRD (Planned Non-Residential Development) Site Plan approval 8 granted under this Resolution is specifically conditioned to the requirement that the 9 petitioner, St. Lucie Self Storage, LLC, including any successors in interest, shall 10 obtain all necessary development permits and construction authorizations from the 11 appropriate State and Federal regulatory authorities, including but not limited to: the 12 United Stated Army Corp of Engineers, the Florida Department of Environmental 13 Protection, and the South Florida Water Management District, prior to the issuance of 14 any local building permits or authorizations to commence development activities on the 15 property described in Part B. 16 17 E. A Certificate of Capacity #2795, a copy of which is attached to this Resolution as 18 Exhibit B, was granted by the Director of Growth Management on August 28, 2009, 19 which certificate shall remain valid for the period of Site Plan approval or any extension 20 granted thereto. If this order expires or otherwise terminates, the Certificate of 21 Capacity shall automatically terminate. 22 23 F. The St. Lucie County Director of Growth Management is hereby authorized and 24 directed to cause the notation of this resolution to be made on the Official Zoning Map 25 of St. Lucie County. Florida, and to make notation of reference to the date of adoption 26 of this resolution. 27 28 G. The Director of Growth Management shall coordinate the issuance of further site 29 Development Permits. No final site construction authorizations or site Development 30 Permits shall be issued until all requirements for such permits are met. 31 32 H. This resolution shall be recorded in the Public Records of St. Lucie County. The 33 recording of this resolution does not authorize commencement of any on-site 34 development activities without obtaining such further development permits as may be 35 required. All applicable conditions of approval as set forth above, and applicable code 36 requirements must be met to the satisfaction of the County before final site 37 construction permits are issued. 38 39 I. A copy of this Order shall be attached to the site plan drawings described in Part A, 40 which shall be placed on file with the St. Lucie County Growth Management Director 41 and mailed, return receipt requested to the developer and agent of record as identified 42 on the site plan application. 43 44 J. The conditions set forth in Part A are an integral nonseverable part of the Preliminary/ 45 Final PNRD (Planned Non-Residential Development) Site Plan. If any condition set 46 forth in Part A is determined to be invalid or unenforceable for any reason and the 47 developer declines to comply voluntarily with that condition, the site plan approval 48 granted by this resolution shall become null and void. 49 Page 4 Resolution No. 09-008 September 15, 2009 File No. PNRD 06-008 1 I K.
