LUCIE AG PARK 7 8 WHEREAS, the St. Lucie County Growth Management Director has reviewed the 9 application for site plan approval submitted by Dean Dekker, reviewed the comments of 10 the St. Lucie County Development Review Committee on this application, and made the 11 following determinations: 12 13 1. St. Lucie AG Park is a proposed 7 lot subdivision on 73.32 acres of property in the 14 AG-5 (Agricultural - 1 unit per 5 acres) Zoning District, located on the north side of 15 Orange Avenue (SR 68), at the NE Corner of Orange Avenue and the C-24 Canal. 16 17 2. On December 7, 2005, the Board of Adjustment granted a variance from the 18 Provisions of Section 7.05.02(A)(9), of the St. Lucie County Land Development 19 Code, to allow the construction of a permanent dead-end street, which will have a 20 length of approximately 2,645 feet and exceed by 1,645 feet the maximum length of 21 1,000 feet allowed for the property. 22 23 3. The Development Review Committee has reviewed the site plan for the proposed 24 .project and found it to meet technical requirements of the Land Development Code 25 and to be consistent with the St. Lucie County Comprehensive Plan. 26 27 4. The project is consistent with the general purpose, goals, objectives, and standards 28 of the St. Lucie County Comprehensive Plan and the St. Lucie County Land 29 Development Code. 30 31 5. The project will not have an undue adverse effect on adjacent property, the 32 character of the neighborhood, traffic conditions, parking, utility facilities, or other 33 matters affecting the public health, safety, and general welfare. 34 35 6. All reasonable steps have been taken to minimize any adverse effect of the 36 .proposed project on the immediate vicinity through building design, site design, 37 landscaping, and screening. 38 39 7. The project will be constructed, arranged, and operated so as not to interfere with 40 the development and use of neighboring property, in accordance with applicable 41 district regulations. The applicant has applied for and received a certificate of capacity, a copy of which 4 is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County 5 Land Development Code. 6 7 8 NOW, THEREFORE, BE IT ORDERED: 9 10 A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the 11 proposed Minor Site Plan to be known as St. Lucie AG Park, is hereby approved as 12 shown on the site plan drawings for the project prepared by Engineering Design & 13 Construction, Inc., dated July 12, 2005 and last revised on September2, 2009, and 14 stamped received by the St. Lucie County Growth Management Department on 15 September 21, 2009, subject to the following conditions: 16 17 1. Prior to Final Plat approval all proposed roadway improvements shall be 18 constructed consistent with the site plan, and approved by the County 19 Engineer, or security provided for those improvements in a manner 20 acceptable to St. Lucie County. The Final Plat for the St. Lucie AG Park 21 shall not be recorded until constructible engineering plans are approved, 22 and all common improvements are either: 23 24 a) built and accepted or approved by St. Lucie County; or 25 26 b) appropriate security is provided to St. Lucie County in a form 27 approved by the County Attorney and an amount approved by the 28 County Engineer, including an amount necessary to cover the period 29 of maintenance required by the Land Development Code. 30 31 2. Prior to Final Plat approval and in accordance with of Section 11.03.02 of the St. 32 Lucie County Land Development Code the property owner, successors or 33 assigns shall submit final copies of the Property Owner Association (POA) 34 documents to the County Attorney's office for review and approval. 35 36 3. Prior to issuance of any St. Lucie County Building Permits (including a SLC 37 Vegetation Removal Permit or Exemption), tree protection barriers shall be in 38 place and verified by SLC Environmental Resources Department staff. The five 39 oak trees labeled "not to be disturbed" on the site plan shall be preserved and 40 protected from construction damage per Section 6..00.05 of the St. Lucie County 41 Land Development Code. 42 October 20, 2009 File No.: MNSP 05-036 Page 2 GM Order No. 09-018 1 4. Any increase in the maximum building or maximum pavement areas as shown 2 on the Site Plan Land Use Table will require a site plan modification in 3 accordance with the provisions of the Land Development Code provisions for 4 Minor Site Plans. 5 6 B. The property on which this Minor Site Plan approval is being granted is described as 7 follows: 8 9 THE WEST 1/2 OF THE NORTHWEST 1/4, LESS ROAD AND CANAL 10 RIGHTS-OF-WAY, OF SECTION 9, TOWNSHIP 35 SOUTH, RANGE 38 11 EAST, ST. LUCIE COUNTY FLORIDA. CONTAINING 73.32 ACRES 12 MORE OR LESS 13 14 Location: North side of Orange Avenue (SR 68), at the NE Corner of Orange 15 Avenue and the C-24 Canal. 16 17 Parcel I D No: 2209-221-0001-0003 18 19 C. The approvals granted by this administrative order shall expire on October 20, 20 2011., unless building permits are issued or an extension is granted in accordance 21 with the provisions of Section 11.02.06 of the St. Lucie County Land Development 22 Code. 23 24 D. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period 25 as this order. If this order expires or otherwise terminates, the Certificate of 26 Capacity shall automatically terminate. 27 28 E. The Final Site Plan approval granted under this Order is specifically conditioned to 29 the requirement that the petitioner, Dean Dekker on behalf of Delray Farms LLC, 30 including any successors in interest, shall obtain all necessary development permits 31 and construction authorizations from the appropriate State and Federal regulatory 32 authorities including, but not limited to; the United States Army Corps of Engineers, 33 the Florida Department of Environmental Protection, and the South Florida Water 34 Management District, prior to the issuance of any local building permits of 35 authorizations to commence development activities on the property described in 36 Part B. 37 38 F. This Order shall become effective upon the date of approval indicated below. 39 Should the property owner, developer or authorized agent wish to appeal any 40 condition described in Section A above, all such appeals must be filed in writing with 41 the County Administrator within 30 days of the rendering of this Order, as described 42 in Section 11.02.03(8), St. Lucie County Land Development Code. Should an October 20, 2009 File No.: MNSP 05-036 Page 3 GM Order No. 09-018 1 appeal to this Order be filed, no permitting reviews or further administrative action 2 shall take place on the processing of this development project until the appeal is 3 resolved. 4 ' 5 G. A copy of this Order shall be attached to the site plan drawings described in Part A, 6 which plan shall be placed on file with the St. Lucie County Growth Management 7 Director and mailed, return receipt requested to the developer and agent of record 8 as identified on the site plan applications. 9 10 H.
