LUCIE 9 COUNTY, FLORIDA. to 11 WHEREAS, the St. Lucie County Growth Management Director has reviewed the application for 12 a minor adjustment to a minor site plan submitted by Grace Emmanuel Church, Inc. and 13 reviewed the comments of the St. Lucie County Development Review Committee on this 14 application, and made the following determinations: 15 16 1. Grace Emmanuel Church has proposed a 4,528 square foot addition to an existing 17 15,313 square foot building on 4.82 acres located south of Kitterman Road, la approximately %4 mile west of U.S. Highway No. 1. 19 2 0 2. On March 25, 2004, through Resolution No. CD-04-005, the St. Lucie County Community 21 Development Director granted approval of a minor development site plan known as Grace 22 Emmanuel Church consisting of two (2) construction phases totaling 21,815 square feet 23 of building on the property legally described in Part B. 24 25 3. The Development Review Committee reviewed the minor adjustment to the minor site 26 plan for the proposed project and found it to meet technical requirements of the Land 2 ~ Development Code and to be consistent with the St. Lucie County Comprehensive Plan. 2s 29 4. The project is consistent with the general purpose, goals, objectives, and standards of 3o the St. Lucie County Comprehensive Plan and the St. Lucie County Land Development 31 Code. 32 33 5. The project will not have an undue adverse effect on adjacent property, the character of 34 the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the 35 public health, safety, and general welfare. 36 37 6. All reasonable steps have been taken to minimize any adverse effect of the proposed 3s project on the immediate vicinity throughbuilding design, site design, landscaping, and 39 screening. 40 41 7. The project will be constructed, arranged, and operated so as not to interfere with the 42 development and use of neighboring property, in accordance with applicable district 43 regulations. 44 45 8. The applicant has applied for and received a certificate of capacity, a copy of which is 2 attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land 3 Development Code. 4 5 NOW, THEREFORE, BE IT ORDERED: 6 7 A. Pursuant to Section 11.02.03 (C) of the St. Lucie County Land Development Code, s the Minor Adjustment to the Minor Site Plan for the project to be known as Grace 9 Emmanuel Church, is hereby approved as shown on the site plan (dated September l0 20, 2009 -prepared by Abraham Chabab, Inc.) and the landscape plan (dated 11 September 09, 2009 -prepared by William A. Flint, III) for the project date stamped 12 received by the St. Lucie County Growth Management Department on September 25, 13 2009 is being granted for the property described below, subject to the following 14 conditions: 15 16 1. Prior to issuance of a Vegetation Removal Permit or Exemption, the applicant shall 17 execute an improvement agreement acceptable to St. Lucie County, covering the is cost of all required landscaping, tree mitigation (including tree relocation), 19 irrigation, and related improvements as shown in the site plans. A copy of this 20 agreement can be obtained by visiting the SLCERD website at: 21 httpa/wwwstlucieco.org/erd/index.htm. 22 23 2. Priorto the issuance of a Vegetation Removal Permit or Exemption, the applicant 24 shall obtain and provide the Environmental Resources Department with copies of 25 any required federal and state permits. If federal and state agency compliance 2 5 requires modification to the development plans, the applicant will promptly modify 27 the plans and submit to St. Lucie County for review and approval as required by 2 8 the Land Development Code. The applicant will not use the County's development 29 approval process to prevent compliance with any federal or state agency 3 o requirements. 31 32 3. Prior to the issuance of a building permit, a St. Lucie County driveway permit shall 33 be obtained from the Road and Bridge Department for the relocation of the 34 proposed driveway. 35 36 4. Prior to the issuance of a building permit, a storm water permit fee shall be 37 obtained. In lieu of paying the storm water permit fee to the Public Works 3s Department, St. Lucie County shall recognize the five (5) foot right-of-way 3 9 donation along Kitterman Road. 40 41 5. Within 90 days after receiving final site plan approval, the applicant shall convey 42 the required road right of way for Kitterman Road. Manner and form of conveyance 43 shall be acceptable to the County Attorney. The sketch and legal description shall 44 be prepared by a Florida licensed surveyor and mapper. Pursuant to Chapter 45 7.05.03 of the St. Lucie County Land Development Code, the applicant may be 46 granted credits against road impact fees. 47 4 s 6. Prior to the issuance of a right of way permit for the construction of a five (5) foot 49 sidewalk along Kitterman Road, the applicant shall execute a Road Improvement 5 o Agreementwith St. Lucie County Engineering Department and submit a surety for File No.: SPMN 2220092876 GM-09-019 September 29, 2009 Page 2 1 the proposed public improvements. The amount of surety shall be 115% of the 2 engineer's estimate of probable cost. The amount of surety shall be approved by 3 the County Engineer and the form of surety shall be approved by the County 4 Attorney. Prior to the issuance of a building permit, the petitioner, their successors or 9 assigns shall have entered into an enforceable utility service agreement with the 1 o Port St. Lucie Utility Authority to ensure the provision of water and sewer services. 11 This agreement shall be in a form consistent with the regulations of Port St. Lucie 12 Utilities regarding utility service extensions and service provisions. 13 14 8. Prior to the issuance of any new building permits, all old permits shall be "finaled" 15 by the Building Department. 16 17 B. The property on which this Minor Adjustment to Minor Site Plan is being granted is 18 described as follows: 19 20 LEGAL DESCRIPTION: 21 22 THE NORTH'/s OF LOT 4, BLOCK 3 OF MODEL LAND COMPANY'S SUBDIVISION IN THE 23 SW'/< OF SECTION 15, TOWNSHIP 36 SOUTH, RANGE 40 EAST, ACCORDING TO THE 2 4 PLAT THEREOF AS RECORDED IN PLAT BOOK 1, PAGE 4, OF THE PUBLIC RECORDS OF 25 ST. LUCIE COUNTY, FLORIDA. 26 27 PROPERTY TAX IDENTIFICATION NUMBER: 3415-501-0041-000-0. 28 29 C. This GM Order corrects and supersedes any and all previous Development Orders. 3o D. The approvals granted by this administrative order shall expire on September 29, 2011 31 unless building permits are issued or an extension is granted in accordance with the 32 provisions of Section 11.02.06(A) of the St. Lucie County Land Development Code. 33 E. The Final Site Plan approval granted under this order is specifically conditioned to the 34 requirement that the petitioner, Grace Emmanuel Church, Inc. including any successors 35 in interest, shall obtain all necessary development permits and construction 36 authorizations from the appropriate State and Federal regulatory authorities including, 37 but not limited to: the United States Army Corps of Engineers, the Florida Department of 38 Environmental Protection, and the South Florida Water Management District, prior to the 39 issuance of any local building permits of authorizations to commence development 4 o activities on the property described in Part B. 41 42 F. The conditions set forth in Part A are an integral nonseverable part of the site plan 4 3 approval granted by this Resolution. If any condition set forth in Part A is determined to 44 be invalid or unenforceable for any reason and the developer declines to comply 45 voluntarily with that condition, the site plan approval granted by this resolution shall 4 6 become null and void. 47 48 G. A copy of this Order shall be attached to the site plan drawings described in Part A, File No.: SPMN 2220092876 GM-09-019 September 29, 2009 Page 3 1 which plan shall be placed on file with the St. Lucie County Growth Management Director 2 and mailed, return receipt requested to the developer and agent of record as identified 3 on the site plan application. 4 5 H. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as 6 this order. If this order expires or otherwise terminates, the Certificate of Capacity shall ~ automatically terminate. 8 9 I.
