to WHEREAS, the St. Lucie County Growth Management Director has reviewed the application for a
11 Minor Adjustment to a Minor Site Plan approval submitted by 13f" Street Church of God, reviewed
12 the comments of the St. Lucie County Development Review Committee on this application, and made
13 the following determinations:

15 1. 13t" Street Church of God presented a petition for an addition of 2;760 sq ft of fellowship
16 hall to an existing 9,415 sq ft of church facility on 1.86 acres of land to be known as 13"
17 Street Church of God Fellowship Hall for a property located at 1902 N. 13t" Street in the I
la (Institutional) Zoning District, depicted on the attached map as Exhibit "A."

20 2. The Development Review Committee has reviewed the Minor Adjustment to a Minor Site
21 Plan for the proposed project and found it to meet the technical requirements of the Land
22 Development Code, subject to the conditions set forth in Part "A" of this Growth Management
23 Order.

25 3. The project is consistent with the general purpose, goals, objectives, and policies of the St.
26 Lucie County Comprehensive Plan and regulations set forth in the St. Lucie County Land
27 Development Code.

29 4. The project will not have an undue adverse effect on adjacent property, the character of the
3 o neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public
31 health, safety, and general welfare.

33 5. All reasonable steps have been taken to minimize any adverse effect of the proposed project
34 on the immediate vicinity through building design, site design, landscaping, and screening.

36 6. The project will be constructed, arranged, and operated so as not to interfere with the
37 development and use of neighboring property, in accordance with applicable district
3s regulations.

4 0 7. The project will be served by adequate public facilities and services.

42 8. The applicant has applied for and received a Certificate of Capacity No. 2831, a copy of
43 which is attached to this order as Exhibit "B," as required under Chapter V, St. Lucie County
44 Land Development Code.

46 NOW, THEREFORE, BE IT ORDERED:

4s A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the proposed
49 Minor Adjustment to a Minor Site Plan to be known as 13t" Street Church of God
5o Fellowship Hall, is hereby approved as shown on the site plan drawings for the project, last
51 received by the St. Lucie County Growth Management Director on September 2"d, 2009, for

3 1. No clearing or other site work shall commence until after constructible engineering plans
4 have been approved by the County Engineer and all county environmental permits have
s been issued by Environmental Resources Department pursuant to Section 11.02.08(A)(7)
6 of the St. Lucie County Land Development Code. As of this date of issuance of this
~ Growth Management Order, no constructible site development plans have been submitted

l0 2. Pursuant to Section 11.02.08(A)(6) of the St. Lucie County Land Development Code, no
11 work shall commence on the site until all regulatory permits required from Federal, State,
12 and regional agencies and special districts have been issued. The Florida Department of
13 Environmental Protection, National Pollutant Discharge and Elimination System
14 compliance notice must be submitted to the County Engineer with the constructible site
is plan at the time of building permit application or during permit review or no paving,
16 grading, and drainage permit and no building permit shall be issued. All National Pollutant
l~ Discharge and Elimination System Best Management Practices shall be instituted on the
is site prior to site clearing and maintained daily. Stormwater ponds shall be roughed in at

21 3. This Growth Management Order shall be recorded in the Public Records of St. Lucie
22 County, Florida, in order to provide constructive legal notice of development conditions
23 that run with the land.

2s 4. The Code Compliance Manager shall receive a copy of this Growth Management Order and
26 the site plan it approves and shall not approve any building permits that do not implement
2 ~ or are not consistent with this Growth Management Order and the plans hereby approved.

29 5. Prior to issuance of a Vegetation Removal Permit or Exemption, the applicant shall have
3 0 obtained and provided the Environmental Resources Department with copies of any
31 required federal and state permits. If federal or state agency compliance requires
32 modification to the development plans, the applicant will promptly modify the plans and
33 submit to St. Lucie County for review and approval as required by the Land Development
34 Code. The applicant will not use the County's development approval to prevent
35 compliance with any federal or state agency requirements.

3 ~ 6. Prior to issuance of a Vegetation Removal Permit or Exemption, the applicant shall
38 execute an improvement agreement, acceptable to St. Lucie County, for the cost of all
39 required landscaping, irrigation, and related improvements as shown in the landscape
4 o plan. A copy of this agreement can be obtained by visiting the St. Lucie County
41 Environmental Resources Department website at: http://www.stlucieco.or~/erd/index.htm.

43 7. Prior to the issuance of any Certificate of Completion the petitioner, their successors or
44 assigns shall be required to construct a 5 foot wide concrete sidewalk along 13th Street as
45 shown on the site plan. The applicant shall be required to enter into a Road Improvement
46 Agreement and provide surety for the proposed sidewalk construction before the issuance
4 ~ of the Right of Way Permit.

24 C. The approvals granted by this Growth Management Order shall expire on October 6, 2011,
25 unless building permits are issued or an extension is granted in accordance with the provisions of
26 Section 11.02.06 (B)1 of the St. Lucie County Land Development Code.

2s D. The Minor Adjustment to a Minor Site Plan approval granted under this Growth Management
29 Order is specifically conditioned to the requirement that the petitioner,13th Street Church of God,
3o including any successors in interest, shall obtain all necessary development permits and
31 construction authorizations from the appropriate State and Federal regulatory authorities
32 including, but not limited to; the United States Army Corps of Engineers, the Florida Department
33 of Environmental Protection, and the South Florida Water Management District, prior to the
34 issuance of any local building permits or authorizations to commence development activities on
35 the property described in Part "B."

3 ~ E. A copy of this Order shall be attached to the site plan drawings described in Part "A," and shall be
3 s placed on file with the St. Lucie County Growth Management Director and copies mailed, return
39 receipt requested to the developer and agent of record as identified on the site plan applications.

41 F. The Certificate of Capacity, attached as Exhibit "B," shall be valid for the same period as this
42 order. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically
43 terminate.

45 G. The conditions set forth in Part "A" are an integral non-severable part of the site plan approval as
46 granted by this Order. If any condition set forth in this Order is determined to be invalid or
4 ~ unenforceable for any reason and the developer declines to comply voluntarily with that condition,
4 e the site plan approval granted by this Order shall become null and void.

5o H. This order shall be recorded in the Public Records of St. Lucie County.
