4 AN' ORDER OF THE GROWTH MANAGEMENT DIRECTOR GRANTING
5 APPROVAL FOR A MINOR SITE PLAN KNOWN AS PORT ST. LUCIE
6 SOCIAL SECURITY ADMINISTRATION CONSISTING OF A 15,719
~ SQUARE FOOT OFFICE BUILDING ON 1.57 ACRES IN THE CG,
8 COMMERCIAL GENERAL ZONING DISTRICT ON CERTAIN
9 PROPERTY IN ST. LUCIE COUNTY, FLORIDA.

11 WHEREAS, the St. Lucie County Growth Management Director has reviewed the application for
12 minor site plan approval submitted by Rutherford & Strickland, Port St. Lucie LLC and reviewed
13 the comments of the St. Lucie County Development Review Committee on this application, and
14 made the following determinations:
15
16 1. Port St. Lucie Social Security Administration has proposed a 15,719 square foot office
17 building on 1.57 acres located approximately %a mile south of Kitterman Road on the
18 east side of US Highway No. 1.

20 2. On November 5, 2009 the Development Review Committee reviewed the minor site plan
21 for the proposed project and found it to meet the technical requirements of the Land
22 Development Code and to be consistent with the St. Lucie County Comprehensive Plan.

24 3. On October 30, 2009 the Growth Management Director reviewed and granted the
25 applicant's request for administrative relief as per Section 7.06.01 (F) of the Land
2 6 Development Code. This relief allows for a one (1) foot reduction of parking stall width for
27 fifty-four (54), forty-five (45) degree angle parking stalls.

2 9 4. The project is consistent with the general purpose,. goals, objectives, and standards of
3o the St. Lucie County Comprehensive Plan and the St. Lucie County Land Development
31 Code.

33 5. The project will not have an undue adverse effect on adjacent property, the character of
34 the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the
35 public health, safety, and general welfare.

37 6. All reasonable steps have been taken to minimize any adverse effect of the proposed
38 project on the immediate vicinity through building design, site design, landscaping, and
39 screening.

41 7. The project will be constructed, arranged, and operated so as not to interfere with the
42 development and use of neighboring property, in accordance with applicable district
43 regulations.

45 8. .The project is to be served by adequate public facilities and services.

1 9. The applicant has applied for and received a certificate of capacity, a copy of which is
2 attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land
3 Development Code.

5 NOW, THEREFORE, BE IT ORDERED:

~ A. Pursuant to Section 11.02.03 (A) of the St. Lucie County Land Development Code,
8 the Minor Site Plan for the project to be known as Port St. Lucie Social Security
9 Administration, is hereby approved as shown on the site plan (dated October 10,
l0 2009 -prepared by Mark T. Allison, P.E.), the landscape plan (dated October 22,
11 2009 -prepared by Lucido and Associates, P.A.) and the building elevations (dated
12 October 30, 2009 -prepared by MTA Engineering, LLC) for the project date stamped
13 received by the St. Lucie County Growth Management Department on October 28,
14 2009 is being granted for the property described below, subject to the following
15 conditions:

l~ 1. Prior to issuance of a Vegetation Removal Permit or Exemption, the applicant
18 shall finalize an improvement agreement acceptable to Environmental
19 Resources Department covering the cost of all required landscaping, irrigation,
2 o tree mitigation, tree relocation, and related improvements shown in the site plan.
21 A copy of this agreement can be obtained by visiting the SLC Environmental

25 2. Prior to issuance of a Vegetation Removal Permit or Exemption, forty (40), two
26 and one-half (2.5) inch diameter at breast height (DBH) Laurel Oak trees shall
27 be delivered to the St. Lucie County Jail Nursery.

29 3. Prior to issuance of a Vegetation Removal Permit or Exemption, an updated
3o Gopher Tortoise Survey, per Florida Fish and Wildlife Conservation
31 Commission, shall be required.

33 4. Prior to issuance of a Vegetation Removal Permit or Exemption, the applicant
34 shall have obtained and provided Environmental Resources Department with
35 copies of any required federal and state permits, including but not limited to a
36 Florida Fish and Wildlife Conservation Commission Gopher Tortoise Relocation
37 Permit. If federal or state agency compliance requires modification to the
38 development plans, the applicant will promptly modify the plans and submit to
3 9 SLC for review and approval as required by the LDC. The applicant will not use
4 o the County's development approval to prevent compliance with any federal or
4 i state agency requirements.

4 3 5. Prior to the issuance of a certificate of occupancy, the petitioner, their
44 successors or assigns shall construct the main entrance road located directly
45 south of the parcel and located within the project boundary as depicted on the
4 6 site plan. Construction shall be in accordance with the plans on file with the
47 Public Works Department, including the installation of all landscaping. No
4 8 clearing or other site work shall commence until after constructible engineering

1 plans have been approved by the County Engineer and all county
2 environmental permits have been issued by the Environmental Resources
3 Department pursuant to Section 11.02.08(A)(7) of the St. Lucie Land
4 Development Code. As of this date of issuance of this Development Order, no
5 constructible site development plans have been submitted for review. No work
6 shall commence after the issuance of environmental permits by the county, or
7 any other permits by any other agency, until the County Engineer has approved
8 the constructible site plans.

l0 6. Prior to the issuance of a building permit, the petitioner, their successors or
11 assigns shall have entered into an enforceable utility service agreementwith the
12 Port St. Lucie Utilities Department to ensure the provision of water and sewer
13 services. This agreement shall be in the form consistent with the regulations of
14 Port St. Lucie Utilities regarding utility service extensions and service provisions.

16 7. Prior to the issuance of a building permit, the petitioner, their successors or
17 assigns shall obtain a North St. Lucie River Water Control District permit forthe
la surface water management system.

20 8. Within forty-five (45) days after minor site plan approval the petitioner and/or
21 property owner shall submit recorded copies of the amended condominium
22 documents for Deej Commerce Center.

11 C. The approvals granted by this administrative order shall expire on November 6, 2011
12 unless building permits are issued or an extension is granted in accordance with the
13 provisions of Section 11.02.06 (A) of the St. Lucie County Land Development Code.
14 D. The Final Site Plan approval granted under this order is specifically conditioned to the
15 requirement that the petitioner, Rutherford & Strickland, Port St. Lucie LLC including any
16 successors in interest, shall obtain all necessary development permits and construction
17 authorizations from the appropriate State and Federal regulatory authorities including,
18 but not limited to: the United States Army Corps of Engineers, the Florida Department of
19 Environmental Protection, and the South Florida Water Management District, prior to the
20 issuance of any local building permits of authorizations to commence development
21 activities on the property described in Part B.

23 E. The conditions set forth in Part A are an integral nonseverable part of the site plan
24 approval granted by this Resolution. If any condition set forth in Part A is determined to
25 be invalid or unenforceable for any reason and the developer declines to comply
26 voluntarily with that condition, the site plan approval granted by this resolution shall
27 become null and void.

29 F. A copy of this Order shall be attached to the site plan drawings described in Part A,
3o which plan shall be placed on file with the St. Lucie County Growth Management Director
31 and mailed, return receipt requested to the developer and agent of record as identified
32 on the site plan application.

34 G. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as
35 this order. If this order expires or otherwise terminates, the Certificate of Capacity shall
36 automatically terminate.
