CONSISTING OF A TRUCK STORAGE AND 7 DISTRIBUTON CENTER AND A 460 SQUARE FOOT OFFICE TRAILER s ON 6.47 ACRES IN THE IL, INDUSTRIAL LIGHT ZONING DISTRICT ON 9 CERTAIN PROPERTY SITUATED IN ST. LUCIE COUNTY, FLORIDA. 10 11 WHEREAS, the St. Lucie County Growth Management Director has reviewed the application for 12 minor site plan approval submitted by Frank Vega and reviewed the comments of the St. Lucie 13 County Development Review Committee on this application, and made the following 14 determinations: 15 16 1. Oceanic Transportation, Inc. has proposed a truck storage and distribution center, and 17 a 460 s. f. office trailer on 6.47 acres located on the east side of Boyd Road, 18 approximately 800 feet north of Orange Avenue. 19 20 2. On June 11, 2009 the Development Review Committee reviewed the minor site plan for 21 the proposed project and found it to meet technical requirements of the Land 22 Development Code and to be consistent with the St. Lucie County Comprehensive Plan. 23 24 3. The project is consistent with the general purpose, goals, objectives, and standards of 25 the St. Lucie County Comprehensive Plan and the St. Lucie County Land Development 2 6 Code. 27 28 4. The project will not have an undue adverse effect on adjacent property, the character of 2 9 the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the 3o public health, safety, and general welfare. 31 32 5. All reasonable steps have been taken to minimize any adverse effect of the proposed 33 project on the immediate vicinity through building design, site design, landscaping, and 34 screening. 35 36 6. The project will be constructed, arranged, and operated so as not to interfere with the 37 development and use of neighboring property, in accordance with applicable district 38 regulations. 39 4 0 7. The project is to be served by adequate public facilities and services. However, a well 41 and septic system will be utilized until such time as public water and sewer is available in 42 the future. 43 44 8. The applicant has applied for and received a certificate of capacity, a copy of which is 4 5 attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land 4 6 Development Code. 4 7 File No.: MNSP 920071327 GM -09-014 December 1, 2009 Page 1 1 NOW, THEREFORE, BE IT ORDERED: 2 3 A. Pursuant to Section 11.02.03 (A) of the St. Lucie County Land Development Code, 4 the Minor Site Plan for the project to be known as Oceanic Transportation, Inc., is 5 hereby approved as shown on the site plan (dated March 6, 2009 -prepared by 6 Culpepper and Terpening, Inc.) and the landscape plan (dated April 21, 2009 - ~ prepared by Conceptual Design Group, Inc.) forthe project date stamped received by 8 the St. Lucie County Growth Management Department on April 27, 2009 is being 9 granted for the property described below, subject to the following conditions: 10 11 1. Prior to approval of a Notice of Vegetation Removal Permit or Exemption, the 12 applicant shall finalize an improvement agreement acceptable to Environmental 13 Resources covering the cost of landscaping. A copy of this agreement can be 14 obtained by visiting the St. Lucie County Environmental Resources Department 15 website at: http://www.stlucieco.org/erd/index.htm. 16 17 2. Prior to approval of a Notice of Vegetation Removal or Exemption, the applicant 18 shall have obtained and provided Environmental Resources Department with 19 copies of any required federal and state permits, including but not limited to a US 20 Fish and Wildlife Service (FWS) Incidental Take Permit and associated FWS 21 approved Habitat Conservation Plan. If federal or state agency compliance 22 requires modification to the development plans, the applicant will promptly modify 23 the plans and submit to St Lucie County for review and approval as required by 24 the LDC. The applicant will not use the County's development approval to 25 prevent compliance with any federal or state agency requirements. 26 27 3. Within ninety (90) days of issuance of a Vegetation Removal or Exemption 28 Permit, all Category I and II Invasive Exotic vegetation, as defined by the most 29 recent list by Florida Exotic and Pest Plant Council, shall be removed from the 3 o site. 31 32 4. Prior to the issuance of a building permit, the owner shall be required to submit 33 well and septic permit applications concurrently to the Health Department for 34 review and approval. 35 36 5. Within ninety (90) days after final site plan approval the developer, successor 37 or assign shall enter into a Proportionate Fair Share Agreement, pursuant to 38 Section 5.07. F, acceptable to the Board of County Commissioners, in the amount 39 of $6,814.05 for the future intersection improvements at the Kings Highway and 4 o Orange Avenue intersection. To the extent permitted under Section 5.07. E the 41 proportionate fair-share contribution shall be applied as a credit against Road 42 Impact Fees. 43 44 6. Within ninety (90) days of the date of the approval, the petitioner, his/her 4 5 successors or assigns, shall dedicate and convey to St. Lucie County, in manner 4 6 and form acceptable to the St. Lucie County Attorney, five (5) feet of additional 4 ~ right-of-way for the expansion of Boyd Road along the east-west property line of 4 8 the adjacent property line of the subject property. Said 5 dedication shall be by general warranty deed, free and clear of all liens and 6 encumbrances. 8 7. There shall be no outdoor storage of materials or goods on the property, with 9 the exception of truck trailers and serviceable vehicles. 10 11 8. Prior to the issuance of a building permit, the petitioner, their successors or 12 assigns shall obtain a North St. Lucie River Water Control District permit for the 13 surface water management system. 14 15 B. The Final Site Plan approval granted under this order is specifically conditioned to the 14 requirement that the petitioner, Frank Vega including any successors in interest, shall 15 obtain all necessary development permits and construction authorizations from the 16 appropriate State and Federal regulatory authorities including, but not limited to: the 17 United States Army Corps of Engineers, the Florida Department of Environmental 18 Protection, and the South Florida Water Management District, prior to the issuance of 19 any local building permits of authorizations to commence development activities on the 2 o property described in Part B. 21 22 E. The conditions set forth in Part A are an integral nonseverable part of the site plan 23 approval granted by this Resolution. If any condition set forth in Part A is determined to 24 be invalid or unenforceable for any reason and the developer declines to comply 25 voluntarily with that condition, the site plan approval granted by this resolution shall 26 become null and void. 27 28 F. A copy of this Order shall be attached to the site plan drawings described in Part A, 2 9 which plan shall be placed on file with the St. Lucie County Growth Management Director 3o and mailed, return receipt requested to the developer and agent of record as identified 31 on the site plan application. 32 33 G. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as 34 this order. If this order expires or otherwise terminates, the Certificate of Capacity shall 35 automatically terminate. 36 37 H.
