HomeMy WebLinkAboutGM-06-006 - Unifirst Corporation 1 GM-06-006 2 MNSP-05-037 3 4 AN ORDER GRANTING APPROVAL FOR 5 A MINOR SITE PLAN TO BE KNOWN AS 6 UNIFIRST CORPORATION. 7 s WHEREAS, the St. Lucie County Growth Management Director has reviewed the application for site plan 9 approval submitted by Velcon Group, Inc., reviewed the comments of the St. Lucie County Development io Review Committee on this application, and made the following determinations: 11 12 1. UniFirst Corporation is a proposed 10,510 square foot industrial project for property located in the 13 Kings Highway Industrial Park, in the IL (Industrial, Light) Zoning District. 14 i5 2. The Development Review Committee has reviewed the site plan for the proposed project and 16 found it to meet technical requirements of the Land Development Code and to be consistent with 17 the St. Lucie County Comprehensive Plan. is 19 3. The project is consistent with the general purpose, goals, objectives, and standards of the St. 2 o Lucie County Comprehensive Plan and the St. Lucie County Land Development Code. 21 22 4. The project will not have an undue adverse effect on adjacent property, the character of the z3 neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public 24 health, safety, and general welfare. 25 2 6 5. All reasonable steps have been taken to minimize any adverse effect of the proposed project on z7 the immediate vicinity through building design, site design, landscaping, and screening. 2s z 9 6. The project will be constructed, arranged, and operated so as not to interfere with the 3 o development and use of neighboring property, in accordance with applicable district regulations. 31 32 7. The project is to be served by adequate public facilities and services. 33 34 8. The applicant has applied for and received a certificate of capacity exemption, a copy of which is 35 attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land 3 6 Development Code. 37 3 s NOW, THEREFORE, BE IT ORDERED: 39 4 o A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the proposed 41 Minor Site Plan to be known as UniFirst Corporation, is hereby approved as shown on the site 42 plan drawings for the project prepared by Velcon Group, Inc., dated August 9, 2005, last revised 43 May 11, 2006, and received by the St. Lucie County Growth Management Director on May 14, 44 2006, subject to the following conditions: 45 46 1. No clearing or other site work shall commence until after constructible engineering plans 47 have been approved by the County Engineer and all county environmental permits have been 4 s issued by Environmental Resources Department pursuant to Section 11.02.08(A)(7) of the JOSEPH E. As of this date of issuance of this Development 2 Order, no constructible site development plans have been submitted for review. No work 3 shall commence after the issuance of environmental permits by county, or of any other 4 permits by any other agency, until the County Engineer has approved the constructible site 5 plans. 6 ~ 2. Pursuant to Section 11.02.08(A)(6) of the St. Lucie County Land Development Code, no work s shall commence on the site until all regulatory permits required from Federal, State, and 9 regional agencies and special districts have been issued. The Florida Department of io Environmental Protection, National Pollutant Discharge and Elimination System compliance 11 notice must be submitted to the County Engineer with the constructible site plan at the time of i2 building permit application or during permit review or no paving, grading, and drainage permit i3 and no building permit shall be issued. All National Pollutant Discharge and. Elimination 14 System Best Management Practices shall be instituted on the site prior to site clearing and 15 maintained daily. Stormwater ponds shall be roughed in at the same time the site is cleared 16 of groundcover. 1~ i s 3. This Development Order shall be recorded in the Public Records of St. Lucie County, Florida, 19 in order to provide constructive legal notice of development conditions that run with the land. 20 21 4. The subject property is limited to one (1) tractor trailer per day. If more than one (1) tractor 22 trailer uses the site a day, the driveway permits shall be revoked immediately and new 23 approvals will be required. 24 25 5. Pursuant to the Declaration of Restrictions by UNIFIRST CORPORATION, no driveway, 2 6 whether paved or unpaved, improved or unimproved, shall be allowed to be located in whole 2 ~ or in part within 40 feet of the property line of Lot 2, Block C, Kings Highway Industrial Park 2 s Unit One. 29 3 0 6. The Code Compliance Manager shall receive a copy of this Development Order and the site 3 i plan it approves and shall not approve any building permits that do not implement or are not 32 consistent with this Development Order and the plans hereby approved. 33 34 B. The property on which this minor site plan is being approved is described as follows: 35 36 LOT 1, BLOCK "C", KINGS HIGHWAY INDUSTRIAL PARK, UNIT ONE, ACCORDING TO 37 THE PLAT THEREOF AS RECORDED IN PLAT BOOK 26, PAGE 16 & 16A, PUBLIC 3s RECORDS OF ST. LUCIE COUNTY, FLORIDA. (TAX ID#: 1335-801-0028-000-3) 39 40 (Location: Commercial Circle, Fort Pierce, Florida.) 41 42 C. The approvals granted by this administrative order shall expire on May 16, 2008, unless a building 4 3 permit is issued or an extension is granted in accordance with the provisions of Section 11.02.06 44 of the St. Lucie County Land Development Code. 45 46 D. The Final Site Plan approval granted under this Order is specifically conditioned to the 47 requirement that the petitioner, Michael T. Fleming for UniFirst Corporation, including any 4 s successors in interest, shall obtain all necessary development permits and construction 49 authorizations from the appropriate State and Federal regulatory authorities including, but not 50 limited to; the United States Army Corps of Engineers, the Florida Department of Environmental File No.: MNSP-05-037 GM Order 06-006 May 16, 2006 Page 2 w 1 Protection, and the South Florida Water Management District, prior to the issuance of any local 2 building permits of authorizations to commence development activities on the property described 3 in Part A. 4 5 E. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan 6 shall be placed on file with the St. Lucie County Growth Management Director and mailed, return 7 receipt requested to the developer and agent of record as identified on the site plan applications. e 9 F. The Certificate of Capacity Exemption, attached as Exhibit A, shall be valid for the same period 1 o as this order. If this order expires or otherwise terminates, the Certificate of Capacity Exemption 11 shall automatically terminate. 12 13 G.
