lz WHEREAS, the St. Lucie County Community Development Director has reviewed the
13 application for site plan approval submitted by Phil & Troy Drawdy, reviewed the comments
14 of the St. Lucie County Development Review Committee on this application, and made the
15 following determinations:

17 1. A 4-lot residential subdivision has been proposed for the project to be known as
is Christensen Acres Subdivisionfor 10± acres of land located on the west side of
19 Christensen Road, approximately 617 feet north of the intersection of West Midway
z o Road and Christensen Road.

za 2. The Development Review Committee has reviewed the site plan for the proposed
a 3 project and found it to meet technical requirements of the Land Development Code
z4 and to be consistent with the St. Lucie County Comprehensive Plan.

a 6 3. The proposed project is consistent with the general purpose, goals, objectives, and
27 standards of the St. Lucie County Comprehensive Plan and the St. Lucie County
z s Land Development Code.

3 0 4. The proposed project will not have an undue adverse effect on adjacent property, the
31 character of the neighborhood, traffic conditions, parking, utility facilities, or other
3a matters affecting the public health, safety, and general welfare.

34 5. All reasonable steps have been taken to minimize any adverse effect of the
35 proposed project on the immediate vicinity through building design, site design,
36 landscaping, and screening.

3 s 6. The proposed project will be constructed, arranged, and operated so as not to
3 9 interfere with the development and use of neighboring property, in accordance with
4 o applicable district regulations.

4z 7. The proposed project is to be served by onsite wells and septic systems.

1 8. The applicant has applied for and received a certificate of capacity, a copy of which
2 is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County
3 Land Development Code.

6 NOW, THEREFORE, BE IT ORDERED:

9 A. Pursuant to Section 11.02.03(A)(5) of the St. Lucie County Land Development Code,
1o the site plan for the project to be known as Christensen Acres S/D be, and the
11 same is hereby, approved as shown on the site plan drawings for the project
12 prepared by James A. Kirby, III, on March 18, 2002 and received by the St. Lucie
13 County Community Development Director on July 16, 2002, and the preliminary plat
14 for the project prepared on March 18, 2002 and submitted to the St. Lucie County
15 Community Development Director on July 16, 2002, for the property described in
16 Part B below, subject to the following condition of approval:

1a 1. Prior to issuance of any building permits for any lot within the Christensen
19 Acres Subdivision, the petitioner, their successors or assigns, shall convey to
20 St. Lucie County, in manner and form acceptable to the St. Lucie County
21 Attorney, the vvester~ eastern ten (10) feet of the parcel for the future
22 widening of Christensen Road.

24 B. The property on which this development will take place is described as follows:

2 6 Lot 86 of the subdivision of Section 5,,Township 36 South, Range 40 East (White City)
2~ as per Plat thereof recorded in Plat Book 1, Page 23, Public Records of St. Lucie

37 C. The approvals and authorizations granted by this CD-Order are for the purpose of
3 s obtaining final plat approval and shall expire on August 14, 2004, unless the
3 9 developer has obtained final plat approval for this development, or an extension has
4 o been granted in accordance with Section 11.02.06, St. Lucie County Land
41 Development Code.

43 D. The Final Site Plan approval granted underthis resolution is specifically conditioned
44 to the requirement that the petitioner, Phil and Troy Drawdy, including any
45 successors in interest, shall obtain all necessary development permits and
46 construction authorizations from the appropriate State and Federal regulatory
4 ~ authorities including, but not limited to; the United States Army Corps of Engineers,

1 the Florida Department of Environmental Protection, and the South Florida Water
z Management District, prior to the issuance of any local building permits of
3 authorizations to commence development activities on the property described in Part
4 B.

6 E. A copy of this Order shall be attached to the site plan drawings described in Part A,
7 which plan shall be placed on file with the St. Lucie County Community Development
a Director and mailed, return receipt requested to the developer and agent of record as
9 identified on the site plan applications.

11 F. The certificate of capacity, attached as Exhibit A, shall be valid for the same period
12 as this order. If this order expires or otherwise terminates, the certificate of capacity
13 shall automatically terminate.

15 G. This order shall be recorded in the Public Records of St. Lucie County.
