4 AN ORDER GRANTING APPROVAL FOR A
5 MINOR SITE PLAN TO BE KNOWN AS
6 BURNSED WAREHOUSE
a WHEREAS, the St. Lucie County Community Development Director has reviewed the application for
9 site plan approval submitted by Culpepper & Terpening, Inc., reviewed the comments of the St.
to Lucie County Development Review Committee on this application, and made the following
11 determinations:

13 1. Burnsed Warehouse is a 9,000 square foot commercial distribution
14 warehouse proposed for 2.04 acres of property located on the east side of
15 Boyd Road, approximately 225 feet north of Orange Avenue in the IL
16 (Industrial, Light) Zoning District.

1$ 2. The Development Review Committee has reviewed the site plan for the
19 proposed project and found it to meet technical requirements of the Land
2 o Development Code and to be consistent with the St. Lucie County
21 Comprehensive Plan.

2 3 3. The revised project is consistent with the general purpose, goals, objectives,
24 and standards of the St. Lucie County Comprehensive Plan and the St. Lucie
25 County Land Development Code.

27 4. The revised project will not have an undue adverse effect on adjacent
2 a property, the character of the neighborhood, traffic conditions, parking, utility
z 9 facilities, or other matters affecting the public health, safety, and general
3 o welfare.

32 5. All reasonable steps have been taken to minimize any adverse effect of the
33 proposed project on the immediate vicinity through building design, site
34 design, landscaping, and screening.

36 6. The revised project will be constructed, arranged, and operated so as not to
3 ~ interfere with the development and use of neighboring property, in
3 s accordance with applicable district regulations.

4 0 7. The revised project is to be served by adequate public facilities and services.

42 8. The applicant has applied for and received an updated certificate of capacity,
43 a copy of which is attached to this order as Exhibit A, as required under
44 Chapter V, St. Lucie County Land Development Code.

2 NOW, THEREFORE, BE IT ORDERED:

5 A. Pursuant to Section 11.02.03 (D) of the St. Lucie County Land Development Code, the
6 proposed minor site plan to be known as Burnsed Warehouse, is hereby approved as
7 shown on the site plan drawings for the project prepared by Culpepper & Terpening, Inc.,
a May 1,2002, and received by the St. Lucie County Community Development Director on May
9 1, 2002, on the property described as follows:

11 LOTS 3, 4, AND 5, BLOCK A, CARBOY INTERNATIONAL PARK UNIT ONE,
12 ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 28, PAGE 13 OF
13 THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA.

2 o B. The approval periods described in Administrative Order CD-02-009 shall remain in full force
21 and effect. The approvals granted by this administrative order shall expire on May 13, 2004,
22 unless an extension is granted in accordance with the provisions of Section 11.02.06 of the
23 St. Lucie County Land DevelopmentCode.

26 C. The Final Site Plan approval granted under this resolution is specifically conditioned to the
27 requirement that the petitioners, Jamesand Brenda Burnsed, including any successors in
z s interest, shall obtain all necessary development permits and construction authorizations from
z 9 the appropriate State and Federal regulatory authorities including, but not limited to; the
3 o United States Army Corps of Engineers, the Florida Department of Environmental
31 Protection, and the South Florida Water Management District, prior to the issuance of any
32 local building permits of authorizations to commence development activities on the property
33 described in Part A.

36 D. A copy of this Order shall be attached to the siteplan drawings described in Part A, which
37 plan shall be placed on file with the St. Lucie County Community Development Director and
3 s mailed, return receipt requested to the developer and agent of record as identified on the
39 site plan applications.

42 E. The certificate of capacity, attached as Exhibit A, shall be valid for the same period as this
43 order. If this order expires or otherwise terminates, the certificate of capacity shall
44 automatically terminate.
