HomeMy WebLinkAboutCD-02-004 - Muller Road Subdivision , a 1 CD-02-004 2 MNSP-02-001 3 4 AN ORDER GRANTING s APPROVAL FOR A MINOR SITE 6 PLAN TO BE KNOWN AS ~ MULLER ROAD SUBDIVISION s 9 WHEREAS, the St. Lucie County Community Development Director has reviewed the application for to site plan approval submitted by Tradewinds Professional Services, Inc. and the comments of the St. 11 Lucie County Development Review Committee on this application, and made the following 12 determinations: 13 14 1. Muller Road Subdivision is a 4-lot subdivision with one access tract proposed 15 for 29.39 acres of property located on the north side of Muller Road, 16 approximately 300 feet west of N.S.L.W.M.D. Canal No. 93 in the AG-2.5 17 (Agricultural - 1 du/2.5 acres) Zoning District. la 19 2. The Development Review Committee has reviewed the site plan for the zo proposed project and found it to meet technical requirements of the Land 21 Development Code and to be consistent with the St. Lucie County 22 Comprehensive Plan. 23 24 3. The revised project is consistent with the general purpose, goals, objectives, z s and standards of the St. Lucie County Comprehensive Plan and the St. Lucie 26 County Land Development Code. 27 2 a 4. The revised project will not have an undue adverse effect on adjacent 2 9 property, the character of the neighborhood, traffic conditions, parking, utility 3 o facilities, or other matters affecting the public health, safety, and general 31 welfare. 32 33 5. All reasonable steps have been taken to minimize any adverse effect of the 34 proposed project on the immediate vicinity through building design, site 35 design, landscaping, and screening. 36 3 ~ 6. The revised project will be constructed, arranged, and operated so as not to 3 a interfere with the development and use of neighboring property, in 39 accordance with applicable district regulations. 40 41 7. The applicant has applied for and received an updated certificate of capacity, 2 a copy of which is attached to this order as Exhibit A, as required under 3 Chapter V, St. Lucie County Land Development Code. 4 5 6 NOW, THEREFORE, BE IT ORDERED: 7 s 9 A. Pursuant to Section 11.02.03 (D) of the St. Lucie County Land Development Code, the to proposed minor site plan to be known as Muller Road Subdivision, is hereby approved as 11 shown on the site plan drawings for the project prepared by Tradewinds Professional 12 Services, Inc., January 29, 2002, and received by the St. Lucie County Community 13 Development Director on February 4, 2002, for the property described as follows: 14 15 WEST 3/a OF THE SOUTHEAST'/a OF THE NORTHWEST'/a OF SECTION 34, TOWNSHIP 16 35 SOUTH, RANGE 39 EAST. LESS THE SOUTH 25.00 FEET FOR RIGHT-OF-WAY. ST. 17 LUCIE COUNTY, FLORIDA. The approvals granted by this administrative order shall expire on February 11, 2004, unless 24 a final plat approval is granted or an extension is granted in accordance with the provisions 25 of Section 11.02.06 of the St. Lucie County Land Development Code. 26 27 2 e C. The Final Site Plan approval granted under this resolution is specifically conditioned to the 29 requirementthat the petitioner, Harold S. Williams, Sr., including any successors in interest, 3 o shall obtain all necessary development permits and construction authorizations from the 31 appropriate State and Federal regulatory authorities including, but not limited to; the United 32 States Army Corps of Engineers, the Florida Department of Environmental Protection, and 33 the South Florida Water Management District, prior to the issuance of any local building 34 permits of authorizations to commence development activities on the property described in 35 Part A. 36 37 3 a D.
