MINOR SITE PLAN TO BE KNOWN AS
8 FIRST REPEAT OF PORTIOFINO SHORES

to WHEREAS, the St. Lucie County Growth Management Director has reviewed the application for site
11 plan approval submitted by Erwin and Lisette Marroquin, reviewed the comments of the St. Lucie
12 County Development Review Committee on this application, and made the following determinations:

14 1. First Replat of Portofino Shores, is a proposed realignment of two platted lots within the
15 Portofino Shores Planned Unit Development for property located at 5600 Sun Valley Drive in
16 the PUD (Portofino Shores- Planned Unit Development) Zoning District.

is 2. The Development Review Committee has reviewed the site plan for the proposed project
19 and found it to meet technical requirements of the Land Development Code and to be
zo consistent with the St. Lucie County Comprehensive Plan.

zz 3. The proposed project is consistent with the general purpose, goals, objectives, and
23 standards of the St. Lucie County Land Development Code, the St. Lucie County
z4 Comprehensive Plan, and the Code of Ordinances of St. Lucie County.

26 4. The proposed project will not have an undue adverse effect on adjacent property, the
27 character of the neighborhood, traffic conditions, parking, utility facilities, or other matters
28 affecting the public health, safety, and general welfare.

3 0 5. All reasonable steps have been taken to minimize any adverse effect of the proposed project
31 on the immediate vicinity through building design, site design, landscaping, and screening.

3 3 6. The proposed project will be constructed, arranged, and operated so as not to interfere with
34 the development and use of neighboring property, in accordance with applicable district
35 regulations.

37 7. The proposed project will be served by adequate pubic facilities and services.

43 A. Pursuant to Section 11.02.03 (D) of the St. Lucie County Land Development Code, the
44 proposed Minor Site Plan to be known as First Replat of Portofino Shores, is hereby

1 approved as shown on the site plan drawings for the project prepared by Culpepper &
a Terpening, Inc. dated July 12, 2006, and received by the St. Lucie County Growth
3 Management Director on July 12, 2006, on the property described below, subject to the
4 following conditions:

6 This Development Order shall be recorded in the Public Records of St. Lucie County, Florida.
~ This Development Order shall be recorded in order to provide constructive legal notice of

13 RECORDED IN PLAT BOOK 43, PAGE 6, PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA.

17 C. The Final Site Plan approval granted under this Resolution is specifically conditioned to the
1e requirement that the petitioner, Erwin and Lisette Marroquin, including any successors in
19 interest, shall obtain all necessary development permits and construction authorizations from
zo the appropriate State and Federal regulatory authorities including, but not limited to; the
21 United States Army Corps of .Engineers, the Florida Department of Environmental
az Protection, and the South Florida Water Management District, prior to the issuance of any
z 3 local building permits of authorizations to commence development activities on the property
24 described in Part A.
a5 D. A copy of this Order shall be attached to the siteplan drawings described in Part A, which
z6 plan shall be placed on file with the St. Lucie County Growth Management Director and
a~ mailed, return receipt requested to the developer and agent of record as identified on the
z s site plan applications.

3o E. The certificate of capacity exemption, attached as Exhibit A, shall be valid for the same
31 period as this order. If this order expires or otherwise terminates, the certificate of capacity
32 shall automatically terminate.

34 F. This order shall be recorded in the Public Records of St. Lucie County.
