LUCIE COUNTY, FLORIDA 7 s WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the 9 testimony and evidence, including, but not limited to the staff report, has made the 1o following determinations: 11 12 1. Benton w. Chambliss presented a petition for a variance from the 13 provisions of Section 7.04.01 (Table 7-10) and Section 8.00.04 (Figure 8-1) 14 of the St. Lucie County Land Development Code to allow 13 masonry 15 columns, 2 walls and gate, 7 feet in height, 22.59 feet into the required front 16 yard setback of 25 feet in the HIRD (Hutchinson Island Residential District) 17 Zoning District, for the property depicted on the attached maps as Exhibit "A" 1s and described below. 19 2 0 2. On December 9, 2009, this Board of Adjustment held a public hearing on the 21 petition, after publishing a notice of such hearing and notifying by mail all 22 owners of property within 500 feet of the subject property. 23 24 3. After consideration of the testimony presented during the public hearing, 25 including staff comments, a presentation bythe Petitioner and the standards 2 6 of review for granting variances set out in Section 10.01.02, St. Lucie County 27 Land Development Code, the Board of Adjustment has made the following 2 s determination: 29 3 o The requested variance has not met the standards of review as set 31 forth in Section 10.01.02, St. Lucie County Land Development Code 3 2 and is in conflict with the goals, objectives, and policies of the St. 3 3 Lucie County Comprehensive Plan, because: 34 3 5 1. The variance requested is not the minimum that would make 3 6 possible the reasonable use of the land, structure, or building. 37 3 s 2. The variance requested would have adverse impacts to other 3 9 property or improvements in the neighborhood. 40 41 3. The variance granted does not meet the general spirit and 4 2 intent of the St. Lucie County Land Development Code and the 4 3 St. Lucie County Comprehensive Plan. JOSEPH E. Less therefrom that certain parcel of 22 land conveyed to the State of Florida for Right-of-Way of State Road A-1-A in 23 Deed Book 218, Page 499, Public Records of St. Lucie County, Florida. 24 25 Parcel Identification Number: 2529-343-0003-000/5 26 27 Location: 4850 South Ocean Drive (SR A1A), Fort Pierce, FL 34949 28 2 9 C.
