LUCIE COUNTY, FLORIDA 7 8 WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony 9 and evidence, including, but not limited to the staff report, has made the following 10 determinations: 11 12 1. Ethel Berkoff presented a petition for a Variance from the Provisions of 13 Section 7.04.01(Table 7-10), of the St. Lucie County Land Development 14 Code, to permit the continued use of a spa with deck and screen enclosure to 15 a single family residence, which will encroach a maximum of 1.35 feet into the 16 minimum side setback of 6 feet required for the project known as Greenbrier 17 @ PGA Village, located in the PUD (Planned Unit Development) Zoning 18 District for the property depicted on the attached map as Exhibit "A" and 19 described below. 20 21 2. On August 26, 2009, this Board held a public hearing on the petition, after 22 publishing a notice of such hearing and notifying by mail all owners of 23 property within 500 feet of the subject property. That meeting was continued 2 4 to the Board's October 28, 2009. 25 2 6 3. On October 28, 2009 the applicant requested the Board continue this item to 27 the next scheduled public hearing. 28 2 9 4. On December 9, 2009, the public hearing was held by the Board of 3o Adjustment. 31 32 5. After consideration of the testimony presented during the public hearing, 33 including staff comments and the standards of review for granting variances 34 set out in Section 10.01.02, St. Lucie County Land Development Code, the 35 Board of Adjustment has made the following determination: 36 37 The requested variance has met the standards of review as set forth in 3 8 Section 10.01.02, St. Lucie County Land Development Code and is not in 3 9 conflict with the goals, objectives, and policies of the St. Lucie County 4 0 Comprehensive Plan, because: 41 4 2 1. The variance granted will not have adverse impacts to other property 4 or improvements in the neighborhood. The property owners 5 association has no objection and the adjacent property to the 6 encroachment is common open space. 7 8 3. The variance granted meets the general spirit and intent of the St. 9 Lucie County Land Development Code and the St. Lucie County l0 Comprehensive Plan. 11 12 NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie 13 County, Florida: 14 15 A. Ethel Berkoff, presented a petition for a Variance from the Provisions of 16 Section 7.04.01(A), of the St. Lucie County Land Development Code, to 17 permit the continued use of a spa with deck and screen enclosure to a single 18 family residence, which will encroach a maximum of 1.35 feet into the 19 minimum side setback of 6 feet required for the project known as Greenbrier 20 @ PGA Village, located in the PUD (Planned Unit Development) Zoning 21 District for the property depicted on the attached map as Exhibit "A" and 22 described below, subject to the following condition: 23 24 The applicant shall be required within 60 days of this approval to 25 address the .9 foot covered porch encroachment into the minimum side 2 6 setback of 6 feet required in the Greenbrier @ PGA Village PUD. 27 28 B. The property on which this Variance approval is granted is described as 2 9 follows: 30 31 LOT 67, PLAT OF POD 19, PUD II, GREENBRIER RECORDED IN PLAT 32 BOOK 41, PAGES 5, 5A THRU 5C, PUBLIC RECORDS OF ST LUCIE 33 COUNTY, FLORIDA. 34 35 ParcellD#: 3322-700-0072-000/2 36 37 (Location: 7614 Greenbrier Circle, Port St. Lucie, FL 34986) 38 39 C.
