A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS GRANTING
HEALTH-CHEM DIAGNOSTICS, LLC MAJOR SITE PLAN APPROVAL FOR THE
PROJECT TO BE KNOWN AS HEALTH-CHEM DIAGNOSTICS, IN THE IL
(INDUSTRIAL, LIGHT) ZONING DISTRICT FOR CERTAIN PROPERTY LOCATED
IN ST. LUCIE COUNTY, FLORIDA
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the
testimony and evidence, including but not limited to the staff report, has made the following
determinations:
Health-Chem Diagnostics LLC, presented a petition for Major Site Plan approval to allow
for the construction of a 200,356 square foot medical manufacturing facility on 16.9 acres
located at the northeast corner of Airport West Commerce Park Road and Airport West
Commerce Park Drive in the IL (Industrial, Light) zoning district for the property depicted
on the attached map in Exhibit A, and described in Part B below.
2. The Development Review Committee has reviewed the site plan for the proposed project
and found it to meet the minimum technical requirements of the St. Lucie County Land
Development Code (LDC) and to be consistent with the future land use maps from the St.
Lucie County Comprehensive Plan.
3. The proposed project is consistent with the general purpose, goals, objectives, policies
and standards of review of the LDC, the St. Lucie County Comprehensive Plan, and the
Code of Ordinances of St. Lucie County.
4. The proposed project will not have an undue adverse effect on adjacent property, the
character of the neighborhood, traffic conditions, parking, utility facilities, or other matters
affecting the public health, safety and general welfare.
5. All: reasonable steps have been taken to minimize any adverse effect of the proposed
project on the immediate vicinity through building design, site design, landscaping, and
screening.
6. The proposed project will be constructed, arranged and operated so as not to interfere with
the development and use of neighboring property, in accordance with applicable district
regulations.
7. Water and wastewater service for the proposed project will be served by St. Lucie County
Utilities.
8. The applicant has applied for and received an Environmental Impact Reportwaiverforthe
subject property from the Board of County Commissioners per Section 11.02.09(A)(5)(2) of
the LDC.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie
County, Florida:
A. Pursuant to Section 11.02.07 of the LDC, the site plan for the project to be known as
Health-Chem Diagnostics is hereby approved as depicted on the site plan drawings for
the project prepared by Stiles Architecture Group dated March 29, 2010, and date
stamped received by the St. Lucie County Planning and Development Services Director on
April 2, 2010, for the property described below, subject to the following conditions:
Prior to issuance of a Building Permit, the applicant shall finalize an improvement
agreement acceptable to Environmental Resources Department (ERD) covering
the cost to purchase and install all required landscaping, irrigation, and related
improvements shown in the approved landscape plan. A copy of this agreement
can be obtained by visiting the St. Lucie County ERD website at:
http://www.stlucieco. orq/erdlindex. htm.
2. Prior to a Building Permit, the applicant shall have obtained and provided
Environmental Resource Department with copies of any required federal and
state permits. If federal or state agency compliance requires modification to the
development plans, the applicant will promptly modify the plans and submit to St.
Lucie County for review and approval as required by the Land Development
Code. The applicant will not use the County's development approval to prevent
compliance with any federal or state agency requirements.
3. The applicant shall be required to comply with all conditions of the Final FAA
Hazard Determination on file for building construction and temporary crane
operations with the St. Lucie County International Airport.
4. Prior to the issuance of a right of way permit, the applicant shall execute a Road
Improvement Agreement with St. Lucie County and submit a surety for the
proposed public improvements. The amount of surety shall be 115% of the
engineer's estimate of probable cost. The form of surety shall be approved by the
County Attorney.
5. No development permits shall be issued until complete sets of sealed
constructible final engineering plans, supporting calculations and survey data for
the site work and offsite improvements are approved by the Office of the County
Engineer, Public Works Department, Utilities Department, Environmental
Resources Department, Planning and Development Services Department, Fire
Department and any other agency that may be determined by the Planning and
Development Services Department to be necessarily involved in the review and
approval of the constructible final engineering plans for the site work and offsite
improvements. The determination of whether or not plans submitted by the

applicant constitute a complete set of constructible plans shall be made by the
departments involved in the plan review within five (5) business days of the date
the plans are received in the Department of Planning and Development Services.

B. The property on which this Major Site Plan is being approved is described as follows:
All of Lots 1, 2, and 3, as shown on Airport West Commerce Park Phase 1,
recorded in Plat Book 60, Pages 31 through 35.
C. The approvals and authorizations granted by this resolution are for the purpose of
obtaining building permits on this property, and shall expire on April 13, 2012, unless the
developer has obtained building permits for the site plan described in Part A or an
extension has been granted in accordance with Section 11.02.06.8.2., St. Lucie County
Land Development Code.
D. The Major Site Plan approval granted under this Resolution is specifically conditioned to
the requirement that the petitioners, including any successors in interest, shall obtain all
necessary development permits and construction authorizations from the appropriate State
and Federal regulatory authorities, including but not limited to: the United States Army
Corps of Engineers, the Florida Department of Environmental Protection, and the South
Florida Water Management District, prior to the issuance of any local building permits or
authorizations to commence development activities on the property described in Part B.
E. The Certificate of Capacity, a copy of which is attached to this resolution, shall remain valid
for the period of site plan approval. Should the Site Plan approval granted by this
resolution expire or an extension be sought pursuant to Section 11.02.06.6.2. of the St.
Lucie County Land Development Code, a new certificate of capacity shall be required.
F. A copy of this resolution shall be attached to the site plan drawings described in Part A,
which plan shall be placed on file with the St. Lucie County Planning and Development
Services Director.
G. The conditions set forth in Part A are an integral nonseverable part of the site plan
approval granted by this resolution. If any condition set forth in Part A is determined to be
invalid or unenforceable for any reason and the developer declines to comply voluntarily
with that condition, the site plan approval granted by this resolution shall become null and
void.
H. A copy of this resolution shall be mailed, return receipt requested to the developer and
agent of record. This resolution shall be recorded in the Public Records of St. Lucie
County. The recording of this resolution does not authorize the commencement of any on-
sitedevelopment activities without obtaining such further development permits as may be
required.
