L. The Diatriot will immediately enter into an agree-
men*. granting unto the State Road Department a perpetual
license, easement and right of way_ for the construction,
maintenance and operation of State Road 609, in and to the
following described land, in St. Lucie County, Florida, to-

said Header Canal between State Roads 68 and 70.
aub~ect, however, to the right of the District to use the

and adjacent to said canal cut, in the operations of the
District in maintaining and cleaning acid Header Canal.

Canal shall be deposited upon the right of xay of acid State
Road 609, and that all auoh spoil, vegetation and/or waste
material removed from Said Header Canal shall be removed by
trucks of the County without ezpenae to the District; (b)
that upon caanpletion of each and every operation of cleaning
or maintensnce•of said Header Canal the County x111 repair
all damage to shoulders, slopes, ditches and berms of the
right of way of State Road 609, arising out of or resulting
from the cleaning and maintenance of acid Header Canal, and
will r eators ansti damaged items to condition satisfactory
to the Road Departments State Highway Engineer without
bxpera~ti to tbi iii-dtir6.b't.' .
It is the intention and agreamrat bt the parties hereto
that the reaponaibilitiss, assumed by- the county, set forth
hereinabove is Sub-paragraph's A and B of Ru;areph No. 2
shall be the sole reaponaibility of the County and name are
hereby assumed by the County, and the County does hereby
agree to save harmle8s and pratect the raid district of and
from any and all claims, de®aada or liabilities whatsoever
in connsotion with the siatt~ra hereinabove set forth in said
Sub-paragraphs ~ and $.
