To have and to hold the within granted temporary easement until the ~~ day of ~jf,L 1962, or upon the con2- pliance by District with its covenants hereinafter set forth, whichever be the sooner date. In further consideration of the within grant of temporary ease- ment as well~as the grant of permanent right of way and easement from grantors to grantee by instrument of even date herewith as to a strip of land lying between the above described parcel and the former west right of way line of Header Canal, it is mutually understood and agreed as follows: 1. The District will notify Graves in writing not leas than two (2) weeks in advance of the actual commencement of operations for the widtring and deepening of that portion of Header Canal adjacent to the lands which are the subject of this Agreement, and thereby enable Graves to take such steps as he may deem necessary to preserve the citrus trees now growing on subject land. 2. In the placement of excavated spoil pursuant to this tem- porary easement, the District agrees that maximum care will be exercised to the end that such spoil placement shall in no manner obstruct, bar, or materially interfere with (a) proper water control, drainage and irrigation, and (b) the continuance by Graves of the usual and proper cultivating pro- cedures--both in connection with the citrus grove situate on the remainder of the SE,- of said Section 14. 3. In order to maintain continued water furrow drainage for the above mentioned citrus grove, the District will, where necessary, cause extensions of existing file to be made to the West prior to spoil placement. -2- ,~ gib, ~:.~: ~... ~~ ` ~ ~:
