7. In summary, the covenants herein contained to be kept and
performed by District for the use and benefit of Graves constitute a large
portion of the consideration for the permanent right of way as well as the
temporary easement, herein contained, and the .violation, on the part of
District of any of such covenants, by it to be kept and performed, shall
be remedial in law by action for specific performance or for damages
measured by costs incyrred by Graves to do or perform any action by this
instrument required of District. No contractor or subcontractor or any
other entity or agency involved in the actual construction work of widening
anQ deepening Header Canat shall be concerned with the covenants herein
contained by District to be kept and performed except as may be deter-
mined by their or its contractual arrangement with District.
