WHEREAS, all payments of principal and interest up to and including th• principal together with interest due February 1, 1%1 have been paid and there now regains unpaid by Company to mortg:gee the sum ~,f t4©,000.00; The premise stated; Now, Therefore, in consideration of the sum of 51.00, each to the other in hand paid, the receipt whereof is hereby acknowledged, and in the further consideration of the mutual benefits, the one to the other, by reason of the covenants hereinafter expressed to be kept and performed, it is mutually understood and agreed as follows: 1. From and after the date hereof partial releases, releasing from the lien and operation of the above mentioned mortgage, Blocks and parcels of said mortgaged lands upon payment to the mortgage holder of an amount of money, together with accrued interest thereon in accordance with the schedule in said mortgage set forth as a matter of cousse, shall be executed by First Party at any time up to and including the moaent just prior to any judicial sale that might be held in pursuance of an order of court directing the foreclosure and sale of the aortgaged premises; provided, how- ever, that there be added to the prescribed amount of money being paid for such partial release a sue equivalent to the prorate portion of the court costs, attorney fees, etc., that may have then been incurred by reason of the previous default by Coapany~in the payment of principal and interest as aforesaid. 2.
