Upon rece1pt of the balance of the purc~uBe price w1thin the time allowed, the Owner will promptly execute and do- liver to the Buyer a good and sufficient warranby deed, containing all the usual common law covenants of title, conveying that proper- ty to th~ Buyer in fee simple. 5. Either party fa111ng, to comply with th~ terms of this contract will pay all expense, 1nclud~r~ a reasonable attor- ney'ft ree, iu~ur~ed by the other party b~cause of that failure. -2-
