elects not to correct said defects and remove said encumbrances,
this transaction shall be terminated (unless the Purchaser shall
waive the existence of the said defects and encumbrances and
accept the title subject thereto without diminution of or correc-
tion on the purchase price), in which event this agreement shall
become null and void and the sum now received by the Seller from
the Purchaser, as above recited, shall be refunded to the latter,
who shall not be entitled to any further sums of money for any
costs or expenses had by him. If the Purchaser shall fail to
deliver the aforesaid notice of defects and encumbrances within tn~
time above provided, the defects and encumbrances, except trlOse
arising subsequent to the date of the certificate of the Abstract}
shall oe deemed to be waived.
4. Seller holds an opinion and title guarantee rendered by
BU~B, Middleton, Rogers and Farrell, Esqs., Attorneys at Law,
205 Worth Avenue, Palm Beach, Florida, and issued by LaW)ers Title
aua~anty Fund} Orlando# Florida} as of June 15, 1957, verifying
the state of its title. purchaser shall have the right to procure
at its own expense, a reissue binder from Burns, Middleton, Rogers
and Farrell, Esqa.
