$135.00 in cash the receipt of which is acknowledged by the parties
of the first part, with the balance or $1,265, bearing interest
at six percent (6~) per annum, payable at the rate of $45.00 per
month commencing July 20, 1961, and monthly thereafter until paid,
with s~id payment b~ing applied first to the interest and then to
the principal outstanding, and to pay all taxes, assessments,
or impositions that ~ay be legally levied or imposed upon said land
subsequent to the year one thousand nine hundred sixty (1960).
And in case of fai1ur'e of the said parties of the second part to
ffiake any of the payments or ~ny part thereof, or to perform any
of the covenants on their part hereby made and entered unto, this
contract shall, at the option o~ the parties of the fir. part,
be forfeited and terminated, and the parties of the second part
shall forfeit all payments made, by them on this contract; and such
payments shall be retained by the said parties of the first part
in full satisfaction and liquidation of all damages by them sustained,
and the said parties of the first part shall have the right to
re-enter and take possession of the premises aforesaid without
being liable to any action therefor.
IT IS MUTUALLY AGREED, by and between the parties hereto,
that the time of each payment shall be an essential part of this
contract, ano that all covenants ard agreements herein contained
shall extend to and be obligatory upon ~e heirs, executors,
administrators and assigns of the respective parties.
IN WITNESS WHEREOF, The parties to these presents ,',ave
hereunto set their hands and seals the day and year first above
written. .
