SUBORDINATION OF ENCUMBRANCE TO PROPERTY
. RIGHTS. TO STATE OF FLORIDA
KNOW ALL MEN BY THESE PRESENTS: That Whereas, it is
proposed by the STATE OP FLORIDA, by and through its component
agency, The State Road Department of Florida, to locate, con-
struct, maintain and/or improve a portion of State Road S-611,
Sec tion 94631-260IJ, in St" Luc ie County, Florida, 1n accord ance
with survey and plans on file in the office of the State Road
Department of Florida; and,
WHEREAS, A porti_(~>n of the lands involved and necessary
to said section of road is subject to r~ortgage held by the under-
signed; and,
WHEREAS, On behalf of the State of Florida a request
has been ~ade for the undersigned to subordinate said encumbrance
to the property rights of the State of ~lorida in and to the
portion of t~e premises hereinafter des~ribed.
NOW, THEREFORE, WITNESSETH: That for and in considera-
tion of.the premises and one dollar and other good and valuable
considerations, paid, receipt of which is hereby acknowledged,
tale undersigned subordinates said encumbrance to the property
rights of the State of Florida, to locate, construct, maintain
and/or improve said &ection of road over, through, upon, and/or
across the following described lands, being a portion of the
encumbered premises in St. Lucie County, Florida, to-wit:
The East 8 feet of the following described parcel of land, to-wit:
The North 160 feet of the South 190 feet of the
West 280f4 feet of the East 305.4 feet of the
South half of the NE t of the NE t of the SE t
of Section 12, Township 35 South, Range 39 East;
It being the intent of this deed to convey that part of said land
which lies within 33 feet of the East line of said Section 12,
containing 0.029 of an acre, more or less; insofar as said prem-
ises are affected by the following described encumbrance--now held
by the undersigned:

PROVIDED, ALWAYS, NEVERTHELESS, and it i8 expressly
understood and agreed that this instrument subordinates said
encumbrance insofar as same affects the rights and privileges
of the State of Florida in its use of the land specifically
above described, for highway purposes only, and that nothing
here1n contained shall in any way affect, alter, impair, minimize
or diminish the effect of said encumbrance or the remedies at law
or in equity for recovering thereout, or aga1nst the parties
