This cause came on for hearing before me on September 14,
1961, on Plaintiff's Motion for Summary Judgment against the Defendants,
FRED D. McCLEERY and GEORGE W. BROUGH, and each of them,
and the Plaintiffls Motion for Leave to Amend its Complaint, and the
Court having considered argW11€:lt of counsel for the pa,rtie3, and it
appearing to the Court ,that there is no genuine issue as to any material
fact and that the Plaintiff is entitled to judgment against said Defendants
