9. The grantee, his lessee or family, is given permission to use for fishing or bathing or boating the
bakes and Canals as shown on Plat of Lakewood Park, but Grantee may not construct anything extend-
ing into or over the watery of the canrls or lakes. No boats shall be anchored off shore in the canals or
lakes, and when not in use shall be kept as closely adjacent to the bank as safety allows to the end that
navigation of the waterways will not be impeded. Any use of the canals or lakes shall be at the sole and
absolute risk of the person so using.
10. No filling or dredging may be done beyond any lot line, nor shall any cutting of boat slips or
similar excavating within the lot line be done ;nor any bulkhead or sea wall be built until plans have been
approved by Grantor.
11. If a lot borders n canal or lake, the bed of the canal or lake atul the waters above such bed are
not included.
12. Portions of the Plat marked "Reserved" is the private property of the Grantor and not subject to
these conditions and restrictions and the Grantor reserves the right to release in whole or in part any
restriction hereunder or to include in any contract or deed hereafter made any additional restrictive
covenants providing same are not inconsistent with these h^rein contained.
13. Any and all rights and reservations of the Grantor herein included may be transferred or as-
signed by the Grantor to a Property Owners Association or some corporate or non-corporate organization
whose purpose it is to provide for the welfare of Lakewood Park. All purchasers of residence property
are to be automatically entitled to membership and voting rights in an association of Owners to be form-
ed for the purpose of enforcing the convenants and maintaining the high standards of Lakewood P<trk.
All owners shall be entitled to equal rights in the use of streets, park areas, lakes and canals and any
other use of property which shall be set apart by the Grantor and be maintained by the Property Own-
ers Association when formed or a corporate or non-corporate organization. Grantee will pay $11 for
each lot to Grantor, his nominees or assigns, on February 1, of each year, said sum to be used for gen-
eral maintenance, •
14. The Grantor reserves to itself the roads and ways shown on the Plat referred to herein and re-
serves the right at any time to dadicate all roads or ways shown on Plat to public use or to convey same
to the State, County or City or an ~ agency thereof.
15. For the breach of any of the above restrictions, the Grantor shall be entitled to apply for relief
by injunction in addition to any other remedy and failure of the Grantor to enforce a restriction herein
shall not he deemed a wavier of a right to do so thereafter as to the Game, a priol•, or subsequent breach,
and Grantor Gh:~li not be held liable for said failure to enforce any restriction herein.
16. All of the covenants and restrictions shall remain in force until January 1, 1968, and shall be
automatically renewed for each 5 year period thereafter unless owners of at least two-thirdG of the lots in
the development shall, at least six months prior to any such renewal date, agree in writing to a change in
or an abrogation of any of the above Covenants, and records such writing so amending the aforesaid
