T H I S A G R E E M E N T
Made this 9th day of December, 1961 between AGNES M. HINMAN,~
as executrix of the Grove Wood Hinman Estate, and the FORT PIERCE ROTE
COMPANY, INC, both of Madison, NewYoi•k, parties of the first part, herein
after designated as the seller, and FRANCES W. FENNIMORE, of Middle-
ville, Herkimer County, New York, hereinafter designated as the purchaser.
• V{/ITNESSETH:
1. The seller agrees to sell and convey the premises known as the
Fort Pierce Hotel, more particularly described in a deed dated March 2, 1946
and recorded March 2, 1946 in book of deeds No. 122, at pages 401 and 402
in the County of St. Lucie, Florida, together with all buildings and improve-
rnents of record thereon. Irr addition +he seller agrees to sell all of the per-
sonal property as shown on a schedule annexed hey eto and marked 'Schedule
A". The seller of the real estate above named, being the Hinman Estate, and
seller of the personal property, being the Fort Pierce Hotel Company, Inc.
2, The premises are sold subject to the following:
(a). To any state of facts which an accruate survey shall show
(b). To all leases and tenancies
(c). To any and all notices, orders or violations of any city,
county, state or federal office, department or authorities
{d~. To licenses and easements, if any, for public utilities
(e). To covenants and reatrictione~ of record, if any, which
still are iri force
(f), To `Encroachments upon any street or road of any stoops,
steps or areas, etc.
(g). 1'o variations, if any, as to retaining walls and the like,

(h). To zoning ordinances and restrictions and amendments
