This conveyance is subject to a mortgage given by
J. W. Whitaker, Jr., to Wright W. Carlton, dated and filed
.for record on May 9, 1962, recorded in Official Records Book 3S,
page 164, public records of St. Lucie Coun*_y, Florida, secur-
ing the original principal amount of $15,025.70, bearing
interest from May 9, 1962, at the rate of five per cent (5%)
per year. Said mortgage encumbers not only the property con-
veyed hereby but also adjacent property in the NW-1/4 of SW-1/4
of said Section 9, conveyed this day by the Grantor, J. W.
,Whitaker, Jr., to Whitaker Groves Incorporated. The Grantor
warrants that said mortgage ie not in default. The Grantee
assumes and agrees to pay one-half of the indebtedness se-
cured by said mortgage, including one-half of the interest
accrued thereon since May 9, 1962.
The Grantor, J. W. Whitaker, Jr., and other p~r-
chasers of lands acquired from W. W. Carlton under deeds
filed for record on May 9, 196?., recorded in Official Records
Book 36, at pages 99, 101, 103, 105, 107, 111, 113, 117, 121,
123, 125, and 129, public records of St. Lucie County, Florida,
have exchanged or are now in the process of exchanging certain
mutual and reciprocal easements for roads and canals; said
easements are private easec*aents for common use and benefit
of the lands conveyed under the several deeds referred to
above and are appurtenant to the lands conveyed thereby.
Included therein are road and canal easements along the east
side of the property conveyed hereby, viz., (a) an easement
for the continued operation, maintenance, and use for irrigation
and drainage purposes of the presently existing canal or
ditch, approximately fifteen feet wile, located along, adja-
cent to, and west of that certain roadway described in para-
graph 1 of a certain easement for roads and canals given by
W. W. Carlton and wife to J. W. Whitaker, Jr., and others,
dat.ed~May 7, 1962, filed for record on May 9, 1962, recorded .
