SUMMERLIN and BB'rl'Y L. SUMMERLIN, husband and wife, of Fort Pierce, Florida, herei'itafter called the "Grantors", and CITY OF FORT PIERCE, Fort Pierce, Florida, a municipal corpora- tion, hereinafter called the "Grantee "., '-. WHEREAS, the Grantors are the owners in fee simple of Lot 18, Block C, Ben Hoggls Addition, as per plat thereof on file in Plat Book 1, Page 1, public records of St. Lucie County, Florida, and are desirous of building over and upon the setback line contrary to the zoning of Grantee, and WHEREAS, the Grantee will grant unto the Grantors a special exception upon certain terms and conditions that in the event the Grantee shall need any of the said above described land for public atreets or highway purposes any construction placed by the Grantors within forty-five (45) feet of the center line of Orange Avenue may be removed by the Grantee without any liability for trespass and without liability for damages, either direct, consequential or severance, insofar as the removal of such construction or appur- tenances is involved; NOW THIS INDF~URE WITNESSETH: That in consideration of the sum of One Dollar ($1.00) paid by the Gr~~tee to the Grantors, the receipt of which is hereby acknowledged, and the further consideration as herein set out by the Grantee to the Grantors, the Grantors hereby grant ur.to the Grantee, its successors and assigns, the right and privilege to enter upon the following described land, to-wit: Lot 18, Block C, Ben Haggis Addition, as per plat thereof 011 file in Plat Book 1, page 1, public records of st.
