3. To pay all and singular the costs, charges and expenses, includin~ lawyer's
fees, reasonably incurred or paid at any time by said .Mortgageest, their survivor,
heirs, le~al representatives or assi[!ns, because of the failure on the part of the said
Mort~adora, their survivor, heirs, legal represenlatit'es or assigns, to perfurln,
comply with and abide by each and e1.'enJ the stipulations, a[!reemellts, conditions
and covenants of said promissory note and this deed, or either, and Cl'f'rll sue-h
