HomeMy WebLinkAboutCD-03-020 - Riverside @ Island Dunes Subdivision1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 CD-03-020 MNSP-03-015 AN ORDER GRANTING MINOR SITE PLAN APPROVAL FOR THE PROJECT TO BE KNOWN AS RIVERSIDE @ ISLAND DUNES SUBDIVISION WHEREAS, the St. Lucie County Community Development Director has reviewed the application for site plan approval submitted by Culpepper & Terpening, Inc. and the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: Riverside ~ Island Dunes Subdivision is a 9-lot subdivision proposed for 3.79 acres of property located on the west side of South SR A-l-A, directly north of Island Dunes Country Club and west of Regency Island Dunes, Phase II, in the HIRD (Hutchinson Island Residential District) Zoning District and RU (Residential Urban) Future Land Use Classification. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet technical requirements of the Land Development Code and to be consistent with the St. Lucie County Comprehensive Plan. The project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Comprehensive Plan and the St. Lucie County Land Development Code. The project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. The project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. The project is to be served by adequate public facilities and services. The applicant has applied for and received an updated certificate of capacity, a copy of which is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Development Code. File No.: MNSP-03-015 December 2, 2003 CD Order 03-020 Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 NOW, THEREFORE, BE IT ORDERED: Pursuant to Section 11.02.03 (D) of the St. Lucie County Land Development Code, the proposed minor site plan to be known as Riverside @ Island Dunes Subdivision, is hereby approved as shown on the site plan drawings for the project prepared by Culpepper & Terpening, November 20, 2003, and received by the St. Lucie County Community Development Director on November 20, 2003, for the property described as follows: A PARCEL OF LAND LOCATED ON HUTCHINSON ISLAND IN SECTION 34, TOWNSHIP 36 SOUTH, RANGE 41 EAST, ST. LUCIE COUNTY, FLORIDA, MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGIN AT A POINT OF INTERSECTION OF THE NORTH LINE OF THE SOUTH 2577.66 FEET OF THE NORTH 2858.86 FEET OF SAID SECTION 34 AND THE WESTERLY RIGHT-OF-WAY OF SR AIA; THENCE RUN SOUTH 20 DEG 23 MIN 08 SEC EAST ALONG SAID WESTERLY RIGHT-OF-WAY LINE A DISTANCE OF 440.00 FEET, TO A POINT; THENCE RUN NORTH 72 DEG 24 MIN 10 SEC WEST A DISTANCE OF 686.20 FEET MORE OR LESS TO THE EASTERLY MEAN HIGH WATER LINE OF THE INDIAN RIVER; THENCE NORTHERLY ALONG SAID MEAN HIGH WATER LINE A DISTANCE OF 215.00 FEET MORE OR LESS TO SAID NORTH LINE OF THE SOUTH 2577.66 FEET OF THE NORTH 2858.86 FEET OF SAID SECTION 34; THENCE RUN NORTH 89 DEG 59 MIN 38 SEC EAST ALONG SAID PREVIOUSLY DESCRIBED NORTH LINE A DISTANCE OF 459.00 FEET MORE OR LESS TO THE POINT OF BEGINNING. (Tax ID#: 3534-111-0004-000/8). (Location: The west side of South SR A-l-A, directly north of Island Dunes Country Club and west of Regency Island Dunes, Phase II) The approvals granted by this administrative order shall expire on December 2, 2005, unless a final plat approval is granted or an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. The Final Site Plan approval granted under this resolution is specifically conditioned to the requirement that the petitioners, Palm Coast Builders of South Florida, L.L.C., including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities including, but not limited to; the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part A. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Community Development Director and mailed, return receipt requested, to the developer and agent of record as identified on the site plan applications. If this order expires or otherwise terminates, the certificate of capacity shall automatically terminate. F. This order shall be recorded in the Public Records of St. Lucie County.
