unpcud balcmve, then the Subdivider wilt deliver to tha peuchaser a oerti~oate. of title insur+a~ve issued by a title
insurcmoe oompcmy doing business as such in St. Lucie County, Florida, which verti~ioate oi title insurcmce will show
that the ti#le as eonveyed or as then about to be c~a~veyed by the $ubdivider to the purchaser, is good, mcQketable
or insut~ble; but nothing herein contained shall be co~~strued aa oonstituting the Subdivider in default hereunder
if the'titte insurcmoe certifioate shows claims arising by the Qctian or omission of the purchaser, as distinguished
from the Subdivider. Delivery of notioe the Subdivider desires to make or give pursuamt to the terms hereol may
be eifected or given by persanal delivery or by mcril, addressed to the purchaser at the addresa hereinabove indi- j
cated as suc~i.
Upon the payment, t~u~ough ths normal and regukar paymenta required hereinarbove without ouiticipation or p~e-
payment, of all of the manthly payments required by the parchaser to wmplete the payment of the entire purchase ~
prioe ot the lot(s), Subdivider will execute and deliver a wcar~ty deed free cmd cleoor of all encumbromces ~?d ~
liens, exoepting restrictions appecaing on the reverse side of this agreement ~d any reIeva~t zoning ordincmces
amd tao~es for the year in which such deed is delivered, if the sond taxes shatt not then be due cmd paycsble ior ~
such year; mid the Subdivider will, also at that time, have c~ompleted the paving of the street in front of the lot(s)
~d aLso the side street abutting the lot(s) if the scune is a eomer lot. Sadd deed shaU be prepared cri the expense ~
ot the Subdivider. The required documentary stamps shall be plaCed on the deed by the Subdivider. If aiter use ~
ot reasonable diligenc:e to mal~e title insurable, Subdivider is unable to do so, Subdivider may retuin to purchaser t
all moneys pmd under this ooaitract cmd thereupon shall be released from ~y cmd all obligations hereunder, ~
including brolcer s oommission. Though the preoeding p~ovisions of this ixaagtaph conier upon the purchaser no
- privilege ot prepaying the unpmd balmzoes in adv~ce of their respective maturity dates, the Subdivider grcmts unto
the purchaser the right to prepay the unpaid balamoes due under this c~ontract, in whole or in pc~t, but with the
underst~ding cmd agreement ihat the Subdivider wiA not be required to deliver unto the purchaser the certifieate of
title insurcmce a~d wcar~ty deed hereinabove provided for cmd complete the paving of the sheet, ~ hereinar~ove
provided for, until a date which would be the day upon which through the normal cmd regulcu~ payments required p
to be made under this eontract without ~ticipation or prepayment of all of the monthly payments required by the is
purchaser !o oomplete the pQyment of the entire purchase prioe of the lot(s).
The Subdivider ma~? acoep! or reiect this QpplioaHon without explcmbtian. If this appliaation is rejected. or if
the Subdivider has not acvepted this applivation to purchase within thiriy (30) days from the date hereof, the deposit
shalt be retumed to the purchaser amd both poirties shaU be released trom atl obligations hereunder, cmd no sales
commission shall have been eaQned by, or be pcryable to, any real estate broker or agent in connection with this ;
trcrosaction. IE the Subdivider aevepts this c~ppliocrtion within thirty (30) days from the date hereoi (acceptcmee to
be evidenoed, as atoresaid, by the signature by the Subdivider of a oounterpaQt hereofl, then the within applieation 'i
shall be deemed immediately trcatsformed into am agreement or 1~?d oontrart wherein the Subdivider is the vendor tit

If the purchaser shall fcril to observe or camply with cmy of the terms of this agreement on the pcat of the ~
purchaser to be kept cmd periarmed within sixty (60) days after the Subdivider shall hcrve given the purchaser ~
writtea notioe, then amd in that event all payments theretofore made by the purchQSer shall }.~e retcaned by the
