notify Purchaser in ~riting that the pre~ises are not in a reasan-
able state of appeaza~ce and ~epa3r cansistent with the general
appeara~ce and state of rep~ir of the,ot~her properties with3n the
immed3ate vicinity, the Purchase~ shall accomplish the required re-
pairs or maintenance s~t forth in said natice within fifteen (15)
days after receipt of same.
(b) If th~ Purch~ser shall fail or ~efuse to 4ccomplish
the required repairs or maintenance within the prescribed time,
General, its su~cessors ar assigns, acting by and through its duly
author'ized agents may come upon the premises far the purpose af
doing the necessary work; prdvided, however, that such w~rk shall be
limited to yard maintenance in order to prevent an overgrown or
unkept appearance and to painting and ninor repairs to the exterior
o~ the building or buildings situated on the premises in order to
prevent an unsightly or unsafe caoditio~o
(c) The Purchaser ~hall pay Ge~eral, its success~rs or
assigns, within twenty (20) days after mailing by General of wxitten
natice of the amount of cost or exper.se incurred by it in accom-
plishing the work required by the notice to repair and rnaintain;
Provided, further, that the amount of money set farth in the notice
of paymcnt due shall include ari allowanc~ for overhead not to exceed
15~ of the actual out-of-pocket cost or expense incurred.
3. In the evEnt th~ Purch~ser shall fail or refuse to
make payment of any sum of money owir,g to Genexal, within twenty
(20) days after the mailing by General of written notification of
such payment being due, interest shall accrue on the unpaid amount
at the maximum legal rate of interest in the St~?te of Florida, and
~eneral, its successors or assic~+ns, may undertake collect3on of the~
sum which the Purchaser is obligated to pay hereunder, together with
all costs~,of collection, including a reasonable attorney's fee.
General, its suCCessors or assxgns, in addition to other remedies
prescribed by Florida law, may give rotice to third paYties that it
has acquired a lien against the propex'ty fo~ said amount by filing
a Notice of° Lien among the Public Records of St. Lucie County, which
lien may be foreclosed at any time by the procedure specified for
the fo~eclosure of inechanicsi or statutory liens by the laws of
~lcrida.
4. Any notice required to be given hereunder sha12 be '
deemed sufficiently given if sent by registered or certified mail,
addressed to General at 2828 Cora1 Way, Miami, ~Zorida, and
addressed to the Purchaser at the address presently shown on the
records of Genera~ to be the address nf the Purchaser, or at ~uch
later address or addre~ses as Gerseral or the Purchaser may here-
after designate in ~~riting to #txe. other.
This Agreement shall be banding upon the undersigned
~arties and their respective heirs, successors, personal represen-
tatiwes, adminis#rators, ex~cutors~and assig~s, and ~hall be deemed
to be covenants Yunning with the land.
