~ cj Zaning and regulatory ordinances imposed by
governmental agencies having jurisdiction over the
premises.
The grantor, by the execution an~ delivery Qf this instrument of con-
veyance and by its acceptance of the consieieration paid by the grantee,
hereby agrees with the grantee as follows:
by the Grantor
1 j That the utilities to be installe~ and xnaintained/
on any of the abot~e described property shall in all
cases be underground utilities and, further, that no
structure or other device shall be installed ubove-
~raund by the grantar on the above described proper-
ty except with the prior tvritten approval of the grari-
tee.
2j That the grantar takes cognizance of the fact that
any lines of the grantee constructed on, across and
under the lands h~reby conveyed by grantor will be
conductors of high voltage electricity or other utility
facilities and the grantor, in the exercise ~f any in-
stallation or maint~nance on said property agrees to
use extraorc3inary precaution so as to prevent darnage
and injury to gersans and property within the vicinity
of such lines and facilities, and the qrantor further a-
grees to notify its emgloyees, agents, contractors and
invitees not only as to the existence of any such high
voltage Iines and facilities but if previously nati#ied by
the grantee in writing of the excistence of any other
utility or ~ facilities constructed an, across and under
the lands hereby conveyed, of the existence of such
utility or facility.
3) That all work done by the grantcr in connECtion
with the u.se of fhe abave described lands shall be done
in such a manner as not to interfere with the use and
operation by the grantee of its facilities now or hereaf-
ter located on, above and under the lands hereby con-
~,~eyec~ to grantee; tt~~at the grantor agrees to refzain from
the use with:n the Iands hereby conveyed to the graxztee
of any movable aquipment which is capable of extending
more than 16 feet above graund level; that the grantor
will notify the grantee in writing at least ten { 10) days
prior to performin~; any work in cannection with the in-
stallation and maintenance o£ its underground utiZities,
drainage ca7nals and ingress and egress faci~ities. How-
ever, in the ev~nt of an ~mergency such 10-3ay period
~ shall not apply and such work may be carri~d on at
any time after written notice of the emergency is de-
livered to grantee's West Palm Beach Manager, at
~ West Palm Beach, Florida; that such notice shall state
F the tir:ie of commencement and the nature of the work
~ to be gerformed; and that aII work in ~onnection with
~
I the ~nstallation and maintenance of the grantor's afore-
said fa~ilities sha11 ~e at the sole cost, expense and
liability of the grantor.
