The ~rad~ names, brand names, patents: signs and similar assets are likewise subject to the lien af this martgage, and subject to possession and use by any Receiver appoir,ted by thi4 Court. It is specifically agr~ed that represeritatives of the Mortgagee even though they may be stockholders, di~ectors or officers may be employed by the Receiver. ~ 8. It is specifically agreed that time is the essence of this contract and that no waiver of ~ny obligation here under or of the abligation sec ured hereby sha11 at any time thereafter be held to be a waiver o.f trie terms hereof or of the instrument secured hereby. 9. If foreclosure proceedin~5 of any other mortgage ar trust aeed of any kind should be instituted, the Mortgagee may at its option, immediately or thereafter declare this mortr,age and it indeb ted- ness secured hereby clue and payable, unless a bona fide dispute exists between the I~Iortgagor and claimant. 10. To pay al~ and sing~alar the costs, charges and exp~nses, including lawyers' fees, reasonably ir~curred or paid at any time by ~.he Mortgagee, because of the failur~ o:E the Mortgagor to perform, comply with and abide by each and every the stipulation~, agreements, conditions and covenants of ~he said promissory note and this mortgage, or either, and ever.y such paym~nt shall bear interest from date ~t the rate of lQ~ per annum. 11. An itemized and detailed list of existing tangible personal property encumbered by this mortgage is attached hereto and by reference made a part iiereof and marked Exhibits "A" and "B", however, said list or schedule while intend~d to be inclusive does nat limit or restric.t general identi£ication hereinabove contained and al.l present or after acquired property is enc umber~d hereby whe ther specificall.y described or not. In the normal course af its business the Mortgagor may ~rade in ~ personal proper~y on other sim:~lar or su~stantial ' items the equity in which sha.ll i.mmediately become subject to the li~n hereof. 12.
