AN ORDINANCE RELEASING AND VACATING UTILITY EAS~IENTS ON
bU~tBAR STREET BETWEEN 25TH AND 26TH STREETS EXCEPT ~VER
THE EAST TEN ~'EET THEREOF AND A STRIP TWELVE 1~Ek,~ IN WxDTH
LYING EQURLLY ON EITHER SIl~E OF THE CENTER LINE 0~ SAID
STREE~; PROVIDING FOR AN EFFEC~IVE DATE HEREOF.
WHEREA.S, by Ox~dinance No. C-252, er~ cted August 11, 1952,
Dunbar Street, running East and West between 25th and 26th Street was
closed, vacated and abandoned, reserving unto ~he City of Fort Pierce,
Florid~, the right and authority ta use said street for uCility pur-
poses, including sewer or water mains, and
WHEI~F,AS, the City of Fort Pierce, Florida, has no fur~~er public
use for sa3d utility purposes an, ov~r or upon the en~ire area of said
Duhbar Street so abandoned, but do~s have a public need arad use for
- utility purposes over, in and upon a paxt or port~on ~hereof.
NOW THERE~'ORE BE IT ORDA~NED BY THE FEOPLE OF THE CITY OF FORT
PIERCE, FLORIDA:
Section 1, That from and after the effective date of` this
Ordinance, aZl utility easements reserved unta the City of Fort P3erce,
Flor~da, in, over and upon Dunbar Stre~t, betwe~n 25th and 26th Street
in ~nancipation Park, City of Fort Pierce, Florida, be and the same are
hereby released, vacated and abandoned, except that the City of Fort
Pierce, Florida, reserves and has tih~ right and author~~y to use the
~ast ter. (10~) feet thereof an~ a s~rip of land twelve (12') feet in
•Nidth runnin,~ E~st and West and lying equally {6 feet) on either s~de
of the center line or said Dunbar Streetr far any and all utility pur~
poses, inGl.udin~ sewer or water rnains.
Section 2, This O~dinance shall be and become effective irnmed~-
ately upc~n final passage
