The rights herein granted to Grantee may be assigned or transferred in whole ~ or in part to any c.npany allied or asaociated with Grantee ; provided however, thst such assignment or ::ranafer ahall not relieve Grantee of any of the duties, abligation~ r• or liabilities imposed upon Grantee by thie ingtrument. i~ ~ ~o 11. Grantee will, if requested by Grantor, file with Grantor and its Trustee copiea of all contractor's performance bonds affecting any work or service in connection with r, the construction of the communications syatem on the easement herein granted. ~ 12. The actual physical work of constructing and installing the communications ~ystem cable in the trench and backSiling the treneh, upon and within the easement here- by g~ranted, ahall be carried out within the periad of Agril 10 thr~ugh November 20 in either the year 1966 or the qesr 1967~ or partly in both of said y~ars, aubject to the fol- . lowing conditiona and restrictiona: (a) For the purpoee of thi~ Agreement said communicationa eystem shall be conaidered complete~i when the trench has been backfilled and the grading and seeding work completed to the e~ctent that cc?nditiona permit and as agreed upon by Grantee and Grantor's Chief Englneear. (b) That if guch construction and installatioa wosk shall be commenced between April 10 and November 20. 1966, and nat completed deu~ing said period, the time for com- ptetion nf said eystem i~n 1967 shall be limite~d to the number of duqs computed bp d~ ducting th~ numb~s o! days elapaed between the atarting and stopping of work from the totai number of daya in aaid periad of April 10 to November 20, 1966, plus ZO days. - ~ (c) Tt Grantee doee~ anq euch canstruction and inatallation work after Navember ~ Z0, 1966. snd before April 10~ 1967, or after November 20, 1967, or ' any daya in the year 196? in exceaa af ~hoet camputed for the limitation aet forth in~ a~ove, Grantee ehell psy Grantor a penalty o! ;Z500 per day for each full day of such work ; pravided however~ that in the Ft.
