4. (a) The Owners coveaant that accupancy shall be pcrmitted only upoa ex~ution of e lease which
must coatain clauaes, among othcra, whereia the T.easee:
(1) certifies the accuracp of the ~tatements made in the application and income survey,
(2) agrees that the family income, family composition aad ather eligibility ~quirements, ahall
be deemed substantiai end material abligations of his tenancy; that ht will coinply prcrmptly
with ell requeats fa inforrnation with respect thereto from the Owncrs or the Cummi~ssioner,
and that his failure or refusal to comply with a request for information with ~espect thereto
shall be deemed a violatioa of a substantial obligation of his tenancy,
(3) agrees that, if family incdme limitations for continuing occupancy which may be estab-
lished from time to time by the Commissioner are exceeded the lease may be terminated upon
receiving a thirty day notice in writing fmm the Owners, which may be given at the discretion
of the Owners or at the d'arectian of the Commissioner, '~e will quit and deliver up possession
of the premises,
(4) agrees that at such time as the Own~rs ar Commissioner may direct he will fumish to the
Owners certification of the then current family income.
(b) Owners shall make dwelling accommodations and services af the project available to accu-
pants at charges not exceeding those established in accordance with a schedule aQproved in writ-
ing by the Commissioner. Such accommodations shall not be rented for a period of less than thir
ty days or for more than one year. Commercial facitities, if an~~, shall be rented at nut less than
the rate appmved by the Commissioner. Subleasing of acoommodations shall be prohibited with-
aut prior written approval of Owners and any lease shall so provide. Upon discovery of any unap-
proved sublease, Owners shall immediately demand c~nc~llation and notify the Commissioner
thereof. '
(c) The Owner shall have the right to charge tn and r~aeive from any tenant such amounts as
- from time to time may be mutually agreed upon between the tenant and th~ Owner aad approved
in writing by the Commissioner for any facilities snd/or servioes which may b~e furnished by the
Owner or others to such teaant upon his request, in addition to the facilities and services in-
cluded in the approved "Rental Schedule".
(d) The Commissioner will at any time eniertain a written request foir e rent increase prvperly
supported by substantiating evidence and within a reasonable time shall:
(1) Approve ~ eental schedule that is necessary to compensate for any net increase, occurring
since the last approved rental scheduie, in taxes (other than income taxes) and operatin~q
and maintenance expenses over which owners have no effective control, or
(2) Deny the incr~ase stating the reasons therefor.
S. (a) Owners shall not execute or file for record any instrument which imposes a restriction upon
the sale, leasing, or oocupancy of the property subject to the insured mortgag~e on the basis of
race, color, or creed.
(b) Owners shall not in selecting tenants ~iscriminate against any person or persons by reason
of the fact that there are chil~en in the family.
(c) Owners agree that admission to the pmject shaIl be limited solely to families of low or mod-
erate incame, as de~ned by the Commissioner, and any such femily whose income exceeds the
~ limits established from time to time by the Commissioaer, shall not be eligible for admission to
the project.
(d) Owners agree that, if during the term nf any Iease the family income exceeds the meximum
for continuing occupancy which may from time to time be established by the Commissioner,
OwnerS will at their discretion, ar upon direction af the Commissioner shall, give the lessee notice
that the lease will be terminated or not renewed.
(e) Own~rs agree that (1) each applicant far tenaacy will be required to certify ta Owners the
wtal current income of the family which shall include the ag~regate overall income esrned by
each member of the family cxcept dependent children; and (2) at such tims as the Commissianer
may direct, the household head will be nec~ired to furnish to the Owner~ certi£ication of the
then current family incomes.
