I~ODIFICATIQN AGREEMENT
'rHIS AGREEMENT made and executed this 5~ day of ~7G~1., ,
1965, by and between WAGNER GROVES, ZNC., a Florida corporation,
hereinafter called the inortgagor, and FLORID~A NATIONAL BANK AT
ORLANDO, a corporntion existj.ng under the laws of the Ur.ited
States of Amer~.ca, hereinaf~er called the Mortgagee,
WTTNESSETH: That,
WHEREAS, the mortgagor executed and delivered to the mortgagee
a certain mortgage dated July 20, 19b4, and recorded in Official
ReCOrds Book 94, Page 556, Fublic Records of St. Lucie County,
Florida, and
ti7HEREAS, the parties hereto wisk~ to add an ad~itional para-
g raph to said mortgage,
NOW, ~'HEREFORE,
In consideration of tr.e premises arid of the sum af One Dollar
. "($1.00) to each of the part~.es hereto paid by the other gar~y and
in consideration af the several and mutual agreements herein
contained and ~or other good and valuable consideration, the
;~parties hereto do hereby covenant and agree as follows;
1. That there shall b~ added to said mortgage imr.?ediately
follawing paragraph numbered 9 on the third page of said mortgage
the follot•~ing ;
"10. Mortgagar agrees that none of the real property
encumbered by this mortgage shall be a.ncorporated into a ;
drainage district under the laws of Flarida without first
ob~aining the written consent of the Mortgagee."
2. The mcrtgagor co~v~nants that said mortgage as herein rnodi-
fied is a tirst lien on the property described in said mortgage, ~s
herein modified, that it is the owner af saic~ property, and that
there are no other liens and encumbrances on said mortgaged property,
except that certain mortgage r~coraed in Official. Records Book 39,
Page 291, Public Records of St. Lucie County, Florida, which last
mentioned martgage has been subordinated to the Iien of the first
abave described mortgage and which sub~rdination agreement was
recorded in Official Records Book 94, Page 562, Public Rec~rds of
St . Z,ucie Coun~,y, F~orida .
3. Nothing herein sha11 be cons~rued to modify said m~rtgage
except as herein specifically pravided.
~ 4e Nathiny herein shall k~e construec3 to release the mortgagor
from any obligation oz liability under said mortgage as herein
modified.
5. This agre~ment shall be binding upon the mortgagor and its
- successors and assig~ns and shall inure ~o the benefi~ of said mort-
gagee and its successors and assigns.
