HomeMy WebLinkAboutCD-03-029 - Postobello Subdivision 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 CD-03-029 (MNSP-03-020) AN ORDER GRANTING MINOR SITE PLAN APPROVAL FOR THE PROJECT TO BE KNOWN AS POSTOBELLO SUBDIVISION WHEREAS, the St. Lucie County Community Development Director has reviewed the application for site plan approval submitted by Phillip Strazzula, reviewed the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: A 5-lot residential subdivision has been proposed for the project to be known as Postobello Subdivision on the northeast corner of the intersection of Johnston Road and Immokolee Road. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet technical requirements of the Land Development Code and to be consistent with the St. Lucie County Comprehensive Plan. The proposed project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Comprehensive Plan and the St. Lucie County Land Development Code. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 7. The proposed project is to be served by onsite wells and septic systems. The applicant has applied for and received a certificate of capacity, a copy of which is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Development Code. CD Order 03-029 MNSP-03-020 December 12, 2003 Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 3O 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 NOW, THEREFORE, BE IT ORDERED: Pursuant to Section 11.02.03(A)(5) of the St. Lucie County Land Development Code, the Final Site Plan for the project to be known as Postobello Subdivision be, and the same is hereby, approved as shown on the site plan drawings for the project prepared by James Fowler, on May 22, 2003 and last revised on October 31,2003 and date stamped received by the St. Lucie County Community Development Director on October 31,2003 is being granted for the property described as follows: THE SOUTHEAST ~/~ OF THE SOUTHEAST ~/~ OF SECTION 27, TOWNSHIP 34 SOUTH, RANGE 39 EAST, LESS THE WEST 40 FEET AND LESS THE SOUTH EAST 110 FEET AND LESS THE SOUTH 50 FEET SAID LAND LYING AND BEING IN ST. LUCIE COUNTY, FLORIDA. Parcel contains 34.56 acres more or less (Tax ID#: 1327-441~0001-000/9) (Location: Northeast corner of the intersection of Johnston Road and Immokolee Road) Bo The approvals and authorizations granted by this CD-Order are for the purpose of obtaining Final Plat approval and shall expire on December 12, 2005, unless the developer has obtained final plat approval for the required improvements associated with this development, or an extension has been granted in accordance with Section 11.02.06, St. Lucie County Land Development Code. Final plats for this subdivision must be recorded in the land records of St. Lucie County no later than 12 months following approval of the final plat drawings for this subdivision. The Site Plan approval granted under this resolution is specifically conditioned to the requirement that the petitioner, Anthony Harned, including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities including, but not limited to; the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part A. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Community Development Director and mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. If this order expires or otherwise terminates, the certificate of capacity shall automatically terminate. F. This order shall be recorded in the Public Records of St. Lu¢ie County.
