ORDER OF CANCELLATYON
This cause came on ta be heard upan final hearittg and
the Court having heard te~timony presented in behalf of the parties
to this cause and that the evidence having been submitted to the
Court, and the Court, efter hearing the argumen~ of caunsel, a nd
being fully advised ~n the premises, finds:
That the equities itt tihi~ cauee ar~ wi~h the Pl,aintiffs
in ~h~at there has been a c~mplete failure on the part of ~he
Defendants, the purchasers herein, to pay taxee on the property as
required by the terms of both agreementa. This Court further finds
that according ta the evidence presented in this cause that tenders
of payment~ were improperly m~de.
It is also evidenced from the examination o~ both con-
tracts that they were both improperly dra£ted and cer~ainly improperly
executed under the ~vidence as given by the Defendants es well as
the Plaitttiffs. TheCour~ is not unmindful of the fact that there
is a great dif£erence in the ages of the parchaeers and th~ sellers
~ $nd that these was a complete l.ack of understand~ng and camprehensibn
of the matters per~aining ta bath of the contract~ attd therefare
there cauld be no clear mutual meeting o~ the minds, and in con-
sideratinn thereof
