Lessee asstimes the entire risk of loss from hazard and agrees to keep the property ineured at Lessee's ex- pense tc, protect all intec•ests of Lessor against such risks and in such amot~nts as Lessor may require, inctiiding the liabilit~~ of Lessor for public liabilit~~ and property damage; and if Lessee fails to do so, Lessor ma}~, but shall not be obligated to, insure said property at the e~pense of Lessee. Said inst~rance policies and the proceeds therefrom shall be the sole propertv of Lessor and Lessor sha11 be named as an insured in ali said policies. The proceeds of such insurance, «~hether resulting from loss or damage or return premium, or otiier~~-ise, shall be applie3 to~sard the replacement or repair of the said property or the discharge of the obligations of Lessee here- under ~it tt:e option of Lessor. Lessee shall indemnify and sa~~e Lessor harmless from an~~ and all liability arising out of the use, main- tenance and or deli~•ery of the ~i•opert}•. Lessee shall comply~ and conform to all ]a~~•s, ordinances ar.d regi~lations relating to the pos- session, use or maintenance of the propertp and sa~•e Lessor harniless against actual or asserted ~~iolation and pat• all costs and ex- penses of any~ character occasioned by and ai•ising out of such t~:olations. The Lessee ~+•ill pa~• promptlp ~ti•hen due all taxes and other ptiblic or pr~iti•ate chai•ges against or upon the property as adr9itional i•ental therefor. Lessee ackno~~•ledges that title to said propert~• is ~~ested in the Lessor anii n~ title or right in said property ahall pass to the Lessee excep! the rights herein exp?•essly granted. Lessee shall r.ot permit an~• encumbrance, lien or le~y to be made en said prop- ert~•, and Lessee shail not use or permit said property to t,e used in ciolation of ant• State or Federal Laws. The Lessee shall not assi~n this lease nor artempt to sell mortgage, sublet or pledge the propert}~. t.essor not being the mantifacturer of the property, nor manufacturer's ag~nt, makes no ~t•arranty against patent or latent defects in material, ~~•orkmanship or capacity of the prop- ert~• nor t~'arranties thai the propert~• ~ti-ill fit the reyuirements of any rule, specirication or contract ~•hich provides for specific n?achiner}' or special metho~s, ali liabilities arising therefrom ari~ assumed b~• the Lessee as its sole risk and expense. Lessee shall ha~•e no po~~•er to terrninate this lease during the term hereof for any reason ~~•hatsoe~•er. Lessee promises to pay the aggregate rental reser~•ed heretinder under all circumstances and rent shAll not abate b~~ reason of loss or damage to the property or destruction thei•eof or for any reason «•hatsoe~•er.
