NOW THERE~'ORE, THIS INDENTI.,TRE WITNESSETH: That Florida Power
~ & Light Company, in consideration of the premises and of One Dollar to it
( duly paid by the Trustees at or before the ensealing and delivery af these
; presents, the receipt whereof is hereby acknowledged, and in further evidence
af assurance of the estate, title and rights of the Trustees and in arder furthcr
to secure the payment of bath the principal of and interest and premium, if
any, on the bonds frarn time to time issued und;,r the Mortgage, according
to their tenor and effect and the performance of all the provisions of the
Mortgage (incIuding any instruments supplemental theret~ and any mocli-
fication made as in the Mortgage provided) and of said bonds, hereby grants,
bargains, sells, releases, conveys, assi~ns, transfers, mortganes, pledges, sets
over and confirms ( subject, however, to Excepted Encumbrances as defined
in Section 6 of the ?,Zortgage) unto The Florida National Bank of Jacksonville
and (to the extent of its legal capacity to hold the same for the purposes
hereof) to Bankers Trust Company, as Trustees under the Mortga~e, and to
their successor or successors in said trust, and to said 'Trustees and their
successors and assigns forever, a11 property, real, persvnal and mixed, acquired
by the Campany after the date of the exr;cution and delivery of the Mvrtgage
(except any herein or in the Mortgage, as heretofore supplemented, expressly
excepted), now awned (except any properties heretofore released pursuant to
any provisions of the Mortgage and in the proc~ss of being sold or disposed of
by the Company) or, subject to the provisions of Section 87 of the Mort-
i g~ge, hereaft~r acquired by the Company and wheresoever situated, including
i ( without in any wise limiting or impairing by the enumeration of the
~ sanie the scope and intent of the foregoing) all lands, power sites, flowage
rights, water rights, water locations, water appropriations, ditches, flumes,
reservairs, reservoir sites, canals, raceways, dams, dam sites, aqueduct~, and
' all nther rights or means for appropriating, conveying, storing and supplying
water; all rights of ~~~ay and roads; all plants for the generation of electricity
+ by steam, water and/or other porwer; ali power houses, gas plants, street light-
