absolute risk of the person so usin~,r.

11. If a lot borders a canal or lake, the bed of the ~anal or lake and tht~ ~~~aters abo~~e ~uch bed are
not included.
12. Portions of the Plat marked "Reser~•ed" is the ~~rivate propertti~ of the Grantor and not subject to
these conditions and re~trictionz ~nd the Grantor reser~~ea the riRht to relense in whole or in part any
restrictian hereunder or tu include in any contract or deed hereafter made an~• additional restrictive
covenants providin;~ same are not inconsistent with these herein contained.
13. Any and all riglits and reservations of the Grantor herein included may be transferred or as-
signed by the Grantor to a Property Owners A:~.gaciation or some corporate or non-corporate organization

are to be automatically entitled to membership and voting rights in an association of Owners to be form-

all owners shall be entitled to ec~ual rights in the use of streets, park areas, lakes and canals and any
other use of ~.roperty ~•hich sh~ll be set ap~rt by the Grantor and be maintained by the Yroperty Own-~
ers A~sociation ~vhen formed or a corporate or non-corporate organization. Grantee v~~ill pay $11 for
each lot to Grantor, his nominee~ or a~signs, on February 1, of each year, sdid sum to be used for gen-
eral maintenance,
14. The Grantor reserves to itself the ru~~ts anci wa~~:~ sho~~~n un the Plat referred to herein and re-
ser~~es the right at any time ta dedicate all roads or ~r•a~•s shown on ~'lat to public use or to convey same
to the State, rounty or City or anr• a~ency thereof.
15. For the breach of an~• of the above restrictions, the Grantor shall be entitled to apply for relief
by~ injunetion in addition to any other remedy arid failure of the Grantor to eriforce a restriction herein
shall not. be deemed a~va~ier of a ri~ht to do so tnereafter as to the ~ame, a prior, or subsequent breach,
and Grantor shall not be held ]iable for said failtire to enforce any re~triction herein.
16. .~11 of the co~•enants and restriction~ shall remain in force until January 1, 1968, ~nd shall be
automaticallv rene«•ed for each 5~•ear period thereafter unleGS owners of at least t~~~o-thirds cf the lo~.s in
the de~-elopment shall, at lea•t cix months prior to anr such rene~val date, a~ree in ~vriting to a change in
or an abrogation of any of t~e abo~~e co~•enant~, and records such writing so arnending the aforesaid
coti•enants.
