Mortgagee shall not be held accountable ~ for any delay in making any such payment and need do so only at ita option, though no such delay may result in any additional interest, aost, charges, expense or damage.. The making of any such payment by the Mortgagee shall not be deemed a waiver by Mortqagee of its rights and remediea hereunder nor be construed as excusing the breach or default by Mortgagor. Any such payments made by Mortgagee ahall ` be added to the payments to be made under this Mortgaqe and shall { bear the maximum interest permitted by law and all such suma and interest are deemed secured hereby. ~ h) All sums of money secured hereby shall be~payable without ~4 any relief whatever from any valuation or appraisement laws. ; t t i) Mortgagor will not remove any of the mortgaged property from its present location without the prior written consent of Mortgagee and Mortgagee shall at all times have access to the premises and property, through any of its representatives and shall have free right of inspection at all times. ~ j) Mortgagor will indemnify and save Mortgagee harmless from all loss, costs, damage and liability and/or expense includinq, but not limited to, reasonable attorneys' fees: which Mortgagee may suffer or ~ sustain or incur to obtain or enforce payn?ent, performance or fulfillment , of any of the Mortgage Obligations and in the enforcement or foreclosure ~ of this Mortgage and/or in the prosecution or defense of any action or ~ proceeding against Mortgagor or by reason of any matter growing out of or ~ in connec~ with this tnortgage and/or any of the Mortgage Obligations ~ and/or any of the mortgaged property. ° ~ k) Breach by the Mortgagor hereunder, or under any other { agreement by and beween Mortgagor and Mortgagee, shall be deemed a ~ breach and a default by Mortgagor hereunder. thereby entitling the ; ~ Mortgagee to all of its rights anc~/or remedies prescribed herein and ; permitted by laW. i ; 1) If there be any breach by the Mortgagor of any of the provisions herein set forth, or in the making of any payment when due, or under any other agreement between Mortgagor and Mortgagee, then, in addition to all of the other rights and remedies of Mortgagee; a. Mortgagee is authorized at any time, without notice, (except such as may be compelled by law), in its sole discretion, to enter upon and take possession of the mortgaged property or any part thereof, to perform any acts Mortgagee deems necessary or proper to conserve the security, and to collect and receive all rents, issues and profits, including those past due as well as accruing thereafter, and . b. Mortgagee shall be entitled to, as a matter of strict : ~ right without regard to the value or occupancy of the security, to have a receiver appointed to enter upon and take possession of the premises, collect the rents and profits therefrom and apply the same as the court may direct, such receiver to have all the rights and powers permitted ~ receivers under the laws of the State of Florida. # ! : i c. In any case, Mortgagee or the receiver may also take 1 possession of and for theae purposea use any and all personal property ~ contained in the premises and used by the M+ortqaqor. The expenses ~ (including receiver's fees, counsel fees, costs and agent's commiaeion) ~ incurred pursuant to the powers herein granted, ahall be deemed aecured hereby.
