T H I S M O R T G A G E is made subject t~ the following:
1. That certain mortgage (the same being a first mortgage encumber-
ing the real property hereinabove described) heretofore made
under date of December 15 , 19 54 , by
Frances Kerr Keister, joined by her husband, James Keieter,
to Prudential Life ins e Co of America, the same

TO HAVE AND TO HOLD the same, together with all the teneinents, heredita-
ments and appurtenances thereunto belonging uato the Mortgagee, her heirs and assigns
in fee simple, and the said Mortgagor for itself, its successors and aseigns, covenants
and~ agrees with the Mortgagee, her heirs, legal representatives and assigns, that the
said Mortgagor owns the property encumbered hereby and has full power aad lawful
right to canvey and mortgage them as herewith done; that it shall be lawful for the
said Mortgagee, her heirs, l~gal representatives or assigns at all times peaceably
and quietly to enter upon, hold, occupy and mnjoy the said property and the property
rights~ encumbered hereby; that the said property is free from all encumbrances except
as hereinabove set forth and that the said Mortgagor, its successors and assigas, will
make such further assurances to perfect the title in the said mortgagee, her hea~s,
legal representatives and assigns, as she may reasonably require; and that the said
Mortgagor does hereby fully warrant the title to the said property ~ncumbered hereby
and will defend the same against the lawful claims of all persons whomsoever; provi-
ded always that if the Mortgagor, its successors or assigns, shall pay unto the Mort-
gagee, her heirs, legal representatives or assigns that certain promissory note, of
which the following in words and figures, is a true copy, to-wit:

AFTER DATE, for value received, the undersigned promises to pay to the order of 1
FRANCES KERR LOWE, the sum of One Million Eighty-Four Thousand Five Hundred
Ninety-five and 58/ 100 Dollars (~1, 084, 595. 58), payable in the following installments
on the following dates, to-wit:

The sum of One Hundred Twenty-Two Thousand Three Hundred Sixty-Nine and '

95/100 Dollars ($122, 369, 95) on November l, 1966, and a like sum oa the
lst day of November of each and every year thereafter until such time as the
entire principal balance evidenced by this promissory note shall have been paid
in full.
The principal indebtedness evidenced by this promissory note shall bear interest from
and after the date hereof at the rate of Five Percent (5%) per annum, payable annually.
The payments hereinabove specified shall be applied first towards the paymeat of inter-
est and the balance shall be applied towarda principal. Interest on the amount of the
debt evidenced hereby shall be computed always on the diminishing and unpaid balance
evidenced hereby. ~

Principal and interest shall be payable unto the Payee or holder of thia note at such ~
place or places in Dade County, Florida, as the Payee or holder may specify in writing
from time to time, and a place once specified as the place for the making of such pay-
ments ahall continue as such until it shall have been changed by written notice givea by
the Payee or holder of this note, to the maker, and for the preaeat and until written
notice to the contrary, the Payee hereby specifiea that payments upon the within note
shall be made for her at the offices of Patton & Kanner, 213 Security Trust Building, ~
Miami, Florida. ~
