In the event that the MORTGAGOR herein dces not make the scheduled payments as they become due under the aforesaid f irat , mortgage , then at ihe option of fhe MORTGAGEE herein, the entire balance due hereunder can be deClared due and payable in full on demand by the said MORTGAGEE herein. ~ (3) The MORTGAGOR herein shal) not further encumber this property, except by obtaining ihe permission ~ of the MORTGAGEE herein. ~ ~ (4) The MORTGAGOR herein will at the request of the MORTGAGEE herein, refinance the first mortgage now encumbering this property at any time deemed desirable by the MORTGAGEE herein. The pro- ceeds of said refinancing to be applied against ihe unpaid balance due hereunder. (5) The MORTGAGOR herein will at the request of the M02TGAGEE herein acknowledge this mortgage and the amount still due at the time of the request on a form provided for this purpose by the MORT- GAGEE. (6) Failure on ihe part of ths MORTGAGOR to comply with, perform, or abide by any of the agreements, stipulations, conditions and covenants as set forth above in sections 1, 2, 3, 4 and 5, empowers the MORTGACEE herein, at his opt;on, to dec,lare the entire balance due hereunder to be due and payable ~ at once. Failure of the MORTGAGEE herein, to exerc':se this option at any time shall not constitute a waiver of the righ~ to exercise tfiis option at some later time.
