BARGE CHANNEL AGREEM ENT 145996
INDIAN RIVER MINER.ALS, INC. , a Florida corporation, herein- ~
after called "Graator. and CHRYSLER OUTBOARD CORPORATION, a '
Delaware corporation, hereinafter called "Grantee." in conaideratioa of
the payment by Grantee to Grantor of Ten Dollars and for other good and
valuable consideration, receipt of which is hereby acknowledged by
Grantor, agree:
1. Grantor hereby conveys to Grantee a perpetual, nonexclusive
easement over and through the Barge Channel and its waters situated on
the property described as follows:
A strip 100 feet ia width extending to the navigable chanael
of the Intracoastal Waterway, being:
The North 100 feet of the South 3?5 feet of the North 636. 6
feet of the East 2I3. 05 feet of the SE 1/4 of Section 8, and
the Vifest 360. 0 feet of the S1~ 1/4 of Sectioa 9.
AU lying and being in Township 34 South, R~nge 40 East,
St. Lucie Couaty, Florida,
hereinafter called the "Barge Channel," for the purpases of ingress and
egress to and from the Indian River aad the intracoastal VlTaterway to
Grantee~ s property described in Exhibit A~ together with the right to use
the Barge Channel for speed tests aad other running tests of Grantee~s
motors, boats and other equipment, and for teats of other marine equip-
ment of Grantee or Chrysler Corporation ar aubsidiaries of Grantee or
Chrysler Corporation; provided, however, said speed tests and other
ruaning tests shall not in any manner interrupt or interfere with the use
of said Barge Channel by Grantor, its successors or assigns, in the con-
duct of Grantor's barge terminal buainess.
2. Grantor may grant easements to other persons for the use of
the Barge Channel's waters, provided that Grantor shall not without prior
written con8ent of Grantee aell to, or permit the use of, the Barge Channel
by a businesa competitor engaged in the manufacture or sale of marine
vehicle s, engine s, or drive componente.
