3. Graator shall aot permit,the diacharge into the Barge Channel
of noxious, harmful or i~urious effluents or aubstances.
~„Grantee or Chrysler Corporation, or subsidiaries of Grantee
or Chrysler Corporation, eha11 not, without prior written consent of
Grantor, its auccessors or assigns, place any dock, boat ramp or other
type of conetruction upoa said 100 foot strip described ia paragraph 1 hereof.
5. Grantee, ite successors and assigas (iacluding but without limi-
tatioa subsidiariea of Grantee and Chrysler Corporation and subsidiaries
of Chrysler Corporation) shall aot without prior written consent of Grantor,
its succesaors and assigns, place any dock~ boat ramp or other type of
construction below the meaa high water mark along the common boundary
between the Barge Channel parcel and Parcel 2 described in Exhibit A,
and the provisions of this paragraph shall be deemed a covenant runni.ng
with the title to Parcel Z described in Exhibit A.
6. Neither the Grantor nor the Grantee shall in any way or at any
time be responsible for the reconstructioa or maintenance of the Barge
Channei if the depth deterioratea as a reault of boat traffic, acts of God,
or other means.
~ ~ 7. Grantor hereby covenants that the laad described in paragraph

; 1 is free of all encumbraaces except the existing mortgage of record to

` Dorothy McMillan and fully warrante the title to the property described ia
paragraph 1 and will defend the same againat the lawful claiins of all persons
whomsoever.
8. This agreement shall be binding upon and shall inure to the

benefit of Grantor~s and Crantee~s succesaors and aesigns.
