3. Ia the event that Grantor shall fail to construct or maintain
such stabilized road, then Grantee ehall have the right from time to time
but aot the obligat3on to do so, and the exercise of auch right by Grantee
shall not relieve Grantor of any of ita obligations hereunder.
4. Grantor may grant roadway easements to other persons over
all or portions of the land above described, provided that such easements
may be granted only to owners of property abutting the land above described,
no easement shall ever be granted to the public over the land above de-
scribed except as to Parcel A above, and no easements may be granted
which interfere with the use of the easement granted in this agreemen~
5. Grantor hereby covenants that the la.ad above described is free
of a11 encumbrances except the existing mortgage of record to Dorottiy
McMillan, and fully warrants the title to said land, and will defend the
same against the lawful claims of all persons whomsoever.
6. This agreement ahall be binding upoa and shall inure to the
benefit of Grantor's and Grantee's reBpective successors and assigns.
