(d) The terms buildings or other structures ae
used in this agreement shall not apply to booma of
derricks, draglines, or cranes, or to smokestacks,
utility poles, or signs.
4. This agreement is made ~for the benefit of Chrysler, its suc- ~

cessors and assigae only, and may be enforced by proceedings at law or
in equity agaiast Minerals or any other person violating or attempting to
violate any of the provisions of this agreement, either to restrain violation
or to recover damages or for both remedies.
5. This agreement and any and all terms of the same may be
modified, amended, abrogated, waived or otherwise changed by instru-
ment ia writing executed by Chrysler and Minerals at any time and from
time to time. This agreement and all proviaions of the same shall continue
in force until terminated by Chrysler and Minerals.
6. This instrument shall be binding upon Chrysler's and Mineral's
respective successors and assigns, and invalidation of any one or more
provision8 of the same sha11 not affect any of the provisions which shall ~
