operation and maintenance of said premisea in the same manner,

and to the amae extent that the OWNER might reasonably ao act. ~

PAIM BEACH shall, after payment of all proper charges and ex-
penses, credit the net amount of income which it may receive by
virtue of the within Assignment and from the mortgaged premises,
to any amounts due PAIM BEACH fram the OWNER under the terms !
and conditions of the aforesaid Note and Mortgage. The maztner ;
of the application of such net income, and the item which shall
bc: credited, shall be within the sole discretion of PAtM BEAQi.
The OWNER hereby covenants and warrants to PAI~M BEACH

that O~WNER has not executed anq prior Assignment of said Lease ~
or rentals, nQr has OWNER performed any acts or executed any
other instrwn~nt which might prevent PAIri BEAQi from operating
under any of the terms and conditions of this Assigrnnent, or
which would limit PALM BEAQi in such operatirnn; and OWNER further
covenants and warrants to PAI~+I BEAC~i that OWNEK has not executed
or granted any modification whatever of said Lease, either orally
or in writing, and that the saiu ~se is in full force and
effect according to its original terans, and that there are no
defaults now existing under the said Lease. ~
All of the covenants and agreements hereinabove con-
tained, on the part of either Party, ahall apply to and be bind-
ing upon their heirs, executors, administrators, successors or
assigns.
IN WZTNESS WHEREOF, OWNER has duly executed this Assign-
ment this 12th day of August, 1966.
